Judge William Mazanec

Dion W. Cadiz, 22, of L Street, Turners Falls. Charge of larceny under $250, in Greenfield, amended down from larceny from a building, sentenced to nine-months direct in the house of correction, concurrent with sentence in another case, and given credit for 27 days served. Admitted to sufficient facts for assault and battery, sentenced to nine-months in the house of correction, concurrent with the previous count. Charge of assault and battery with a dangerous weapon, to wit, a red baseball bat, dismissed at request of the commonwealth. A charge of home invasion was nolle prossed back on 12/3/12., to allow these items to remain in district court.

Pleaded innocent to negligent operation of a motor vehicle, operating under the influence of drugs, violation of breakdown lane law, marked lanes violation, possession of a Class A drug, to wit, heroin and possession of a Class B drug, to wit, cocaine, in Deerfield by state police, released on personal recognizance, advised of right to have a drug examination, continued until 4/29/13 for pretrial conference. Must pay legal counsel fee of $150.

Dary J. Wall, 32, of Northfield Road, Warwick. Pleaded innocent to operating under the influence of liquor, negligent operation of a motor vehicle, and disturbing the peace, in Northfield, released on personal recognizance, continued until 4/23/13 for pretrial conference. Must pay legal counsel fee of $150.

Jacob R. Coates, 21, of Call Road, Colrain. Pleaded innocent to operating under the influence of liquor, failing to wear a seat belt, and speeding, in Montague, released on personal recognizance, continued until 4/16/13 for pretrial conference. Must pay legal counsel fee of $150.

Anthony J. Yukl, 21, of Williamsburg. Pleaded guilty to assault and battery, sentenced to two-years in the house of correction, 60 days direct, balance suspended, placed on probation until 2/6/14 with credit for time served, must have no abuse of the victim, and must stay away from and have no contact with the victim. Must pay $65 per month probation supervision fee.

Jacob E. Galipault, 23, of Boyle Road, Gill. Charge of operating with suspended license, in Deerfield, were not prosecuted as, according to a written statement from the district attorney’s office, for the purpose of pleas in two other dockets.

Juan M. Gonzales, 24, of L Street, Turners Falls. Pleaded guilty to assault and battery, in Greenfield, placed on probation until 3/17/14, with victim witness assessment of $50. Charges of two counts of assault with a dangerous weapon, to wit, a knife in both counts, intimidating a witness, and being an accessory after the fact, all dismissed at request of the commonwealth. Must pay legal counsel fee of $150, and $250 legal counsel contribution. Must pay $65 per month probation supervision fee.

Nadine A. Calloway, 45, of Avenue A, Turners Falls. Charge of larceny over $250, was not prosecuted as, according to a written statement from the district attorney’s office, based on the court’s determination that the commonwealth’s sole witness has a valid privilege not to testify, and the commonwealth is unable to proceed.

Daniel A. Williams, 48, of Main Road, Colrain. Pleaded guilty to assault and battery, in Shelburne, sentenced to one-year in the house of correction, suspended, placed on probation until 3/17/14, must have no drugs or alcohol, subject to random testing, and must attend and complete the MOVE anti-battering program. Must pay legal counsel fee of $150. Must pay $65 per month probation supervision fee.

Gregory H. Tidlund, 24, of Chapman Street, Greenfield. Placed on pretrial probation until 9/18/13, for intimidating a witness, and assault and battery, and must have no abuse of the victim. Must pay legal counsel fee of $150. Must pay $50 per month probation supervision fee.

Charles A. Coates, 44, of States Street, Shelburne Falls. Charge of operating with suspended license, to be dismissed on payment of $50 court costs.

Matthew J. White, 35, of Worthington. Charge of operating with suspended license, to be dismissed on payment of $25 court costs.

Gary Palazzo, 24, of Griswold Street, Turners Falls. Charge of operating under the influence of liquor, second offense and marked lanes violation, were not prosecuted, as, according to a written statement from the district attorney’s office, a replacement complaint has been brought.

Benjamin J. Potter, 26, of West Halifax, Vt. Admitted to sufficient facts for possession of Class C drug, to wit, hashish, in Greenfield, but continued without a finding until 3/18/14, must have no drugs or alcohol, subject to random testing, and must have drug and alcohol counseling. Pleaded guilty to disorderly conduct, subsequent offense, resisting arrest, and wanton destruction of property under $250, all placed on probation until 6/19/13. Second charge of wanton destruction of property under $250, dismissed at request of the commonwealth. An order for victim witness assessment of $50, was assessed on the resisting arrest charge. Must pay legal counsel fee of $150, and $50 legal counsel contribution. Must pay $65 per month probation supervision fee.

Gary Palazzo, 24, of Griswold Street, Turners Falls. Admitted to sufficient facts for but continued without a finding until 3/18/14 with $200 court costs. and victim witness assessment of $50, and must take and complete the safe driver program and pay the fee. Must pay $65 per month probation supervision fee.

Ralph E. Gray, 74, of Manchester, N.H. Pleaded innocent to leaving a firearm in a vehicle, and carrying an unloaded rifle/shotgun on a public way, in Rowe by state police, released on personal recognizance, continued until 4/23/13 for pretrial conference, and appearance of counsel.
