Greenfield, Dec. 6, Judge William Mazanec III

Tyler W. Rubeck, 27, of G Street, Turners Falls. Pleaded guilty to breaking and entering into a building in the daytime with intent to commit a felony, sentenced to 18 months in the house of correction, suspended. Placed on probation until 6/5/19, with victim-witness assessment of $90, and must have no drugs or alcohol, subject to screens/tests. Must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Must stay 50 yards away from and have no contact with a named person. Must stay away from a G Street location in Turners Falls, and must have a GPS unit applied. Must take the Reflections program. Pleaded guilty to larceny over $250, placed on straight probation as in the previous count, and with same conditions as is count one. Must pay legal counsel fee of $150. Must perform 8 hours per month in community service, but need not paid while in the Reflections program.

Mark A. Squires, 50, of Brattleboro, Vt. Pleaded guilty to operating a motor vehicle with license suspended in Deerfield by state police. Sentenced to 90 days in the house of correction, with credit for time served and concurrent with two other cases. Pleaded guilty to possessing a Class A drug, to wit, heroin, sentenced to 90 days in the house of correction, with same credit for time served and concurrent with count one. Charge of being a vehicle operator refusing to identify him or herself dismissed on request of the Commonwealth. Charges of miscellaneous motor vehicle equipment violation, and unregistered motor vehicle, filed with defendant’s consent until 6/6/18.

Erin G. Schacht, 37, of Forest Avenue, Greenfield. Pleaded innocent to shoplifting, third offense, at Stop & Shop in Greenfield, Bail set at $200 cash. Continued to 12/27/17 for pretrial conference.

Aldo C. Tatro, 50, listed as homeless of Turners Falls. Pleaded innocent to violation of an abuse prevention order. Released on personal recognizance and must abide by any 209A restraining order in existence. Continued to 1/25/18 for pretrial conference. Must pay legal counsel fee of $150.

Jeffery Arsenault, 34, of South Street, Bernardston. Pleaded innocent to assault and battery on family/household member in Bernardston by state police. Released on personal recognizance. Must have no abuse of the alleged victim, and must have no alcohol and subject to screens and testing. Continued to 2/9/18 for pretrial conference.

Molly A. Farr, 32, of Williamstown, Vt. Admitted to sufficient facts for possessing a Class B drug, to wit, cocaine, with intent to distribute, amended down from trafficking in 18 grams, or more, or less than 38 grams of cocaine. Sufficient facts found, but continued without a finding until 12/5/19. To be dismissed on payment of victim-witness assessment of $90. Must have no drugs, and subject to screens, and must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Charge of conspiracy to violate drug laws was dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month.

Greenfield, Dec. 7, Judge William Mazanec III

Kimberly A. Moul, 41, of Chester, Vt. Found responsible for unlicensed operation of a motor vehicle in Greenfield by state police. Fined $100, and decriminalized, to wit, converted to a civil offense. Found not responsible for failure to wear a seat belt.

Greenfield, Dec. 8, Judge Mark Pasquariello

Richard A. Damboise, 26, of Heather Court, Greenfield. Pleaded innocent to receiving stolen property, and possessing a Class B drug, to wit, cocaine. Released on personal recognizance. Continued to 1/29/18 for pretrial conference.

Bradley McCallum, 51, of Brooklyn, N.Y. Charge of operating a motor vehicle with license suspended in Shelburne by state police. To be dismissed on payment of $50 court costs. Found not responsible for motor vehicle lights violation.

Coty R. Westort, 27, of Harmony Heights, Charlemont. Charge of operating a motor vehicle with license suspended in Buckland to be dismissed on payment of $50 court costs.

Dana L. Rice, 53, of Main Street, Charlemont. Admitted to sufficient facts for being a sex offender failing to register in Charlemont by state police. Sufficient facts found, but continued without a finding until 12/10/18, with victim-witness assessment of $50, and must abide by all conditions on a specified indictment, and must maintain the Sex Offender Registry requirements. Must pay legal counsel fee of $150.

Anthony C. Kurtyka, 27, of Dell Street, Turners Falls. Charge of unlicensed operation of a motor vehicle, to be dismissed on payment of $50 court costs. Found not responsible for no inspection sticker.

Tyler R. Ward, 27, of Conway Street, Greenfield. Placed on pretrial probation until 3/8/18. In Deerfield, negligent operation of a motor vehicle, with head-injury assessment of $250, and must take and complete the Safe Driver Course as done by the National Safety Counsel. Charge of leaving the scene of property damage to be dismissed on payment of $100 court costs.

Heather L. Carpenter, 37, of Chicopee. Charge of operating a motor vehicle with license suspended in Whately by state police. To be dismissed on payment of $50 court costs. Found not responsible for miscellaneous motor vehicle equipment violation.

Released on personal recognizance, and must register by 12/10/17 as required by Sex Offender Board, and must register appropriately with 12 hours if the defendant moves hereafter. Danielle M. Chase, 23, of West Main Street, Orange. Charge of unlicensed operation of a motor vehicle in Erving to be dismissed on payment of $50 court costs. Found not responsible for speeding in violation of special regulation, Must pay $50 per month probation supervision fee.

Jacob Mencher, 28, of Highland Avenue, Greenfield. Found responsible for speeding at a rate of speed exceeding the posted limit, in Erving. Fined $100. Found not responsible for marked lanes violation, Charge of negligent operation of a motor vehicle dismissed on request of the Commonwealth.

Eduardo A. Olmo, 46, of Church Street, Millers Falls. Pleaded innocent to operating under the influence of drugs, negligent operation of a motor vehicle, number plate violation to conceal identification, uninsured motor vehicle, unregistered motor vehicle, number plate violation, and no registration in possession. Must pay counsel fee of $150, or perform 16 hours of community service.

George E. Brooks, 25. Of Church Street, Athol. Admitted to sufficient facts for reckless operation of a motor vehicle in Warwick. Must pay $50 per month probation supervision fee.

Must complete the Womenhood program and must have no drugs or alcohol, and subject to screens/tests, and must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Placed on pretrial probation until 12/11/18 for operating a motor vehicle with license suspended. Found not responsible for no license in possession. Must pay counsel fee of $150, or perform 16 hours of community service. Must pay probation supervision fee of $65 per month.

Frank J. Christiana, 20, of Indian Orchard. Charge of assault and battery in Wendell by state police, as, according to a statement made by a counsel from the district attorney’s office, the alleged victim has asserted a Fifth Amendment privilege and the Commonwealth cannot proceed without her testimony.

John Graham, 54, of Grand Marsh, Wis. Pleaded innocent to assault and battery with a dangerous weapon, to wit, a wooden bat, in Athol. Released on personal recognizance. Continued to 2/12/18 for pretrial conference. Must pay legal counsel fee of $150.

Cidney Clark, 23, of Shore Drive, Athol. Charge of operating a motor vehicle with license suspended dismissed on request of the Commonwealth. Found not responsible for no inspection sticker.

Mitchell P. Rocasah, 22, of Long Plain Road, Leverett. Placed on pretrial probation until 6/11/18 for assault and battery on family/household member, and malicious destruction of property over $250 value in Leverett by state police and must be evaluated for Anger Management, in both charges. Must pay $50 per month probation supervision fee.
