Orange, Nov. 6, Judge David S. Ross

Robert J. Ouellette, 27, of Winchendon. Charge of operating a motor vehicle with license suspended in Erving. To be dismissed on payment of $50 court costs forthwith. Found not responsible for failure to notify the Registry of Motor Vehicles of a name or address change, and failure to drive in the right lane. Must pay $50 default warrant fee.

Greenfield, Nov. 7, Judge William Mazanec III

Francis A. Pabon, 47, of Springfield. Pleaded innocent to being a sex offender failing to register in Greenfield. Bail set at $300 cash or $3,000 surety. Bail was then reduced to $100 cash or $1,000 surety after a hearing in Superior Court on 11/9/17. Continued to 12/6/17 for pretrial conference. Must pay legal counsel fee of $150.

Robert W. Wasielewski, 57, of Harris Court, Greenfield. Pleaded innocent to operating under the influence of liquor or 0.08 percent, fourth or greater offense, possessing an open container of alcohol in a motor vehicle, and failure to stop/yield. Released on personal recognizance. Must have no driving of a motor vehicle, must have no possession of firearms or weapons. Must have no drugs or alcohol, and subject to screens/tests, must take and complete a substance abuse evaluation, and take any after-care treatment recommended, and must abide by their regulations. Must comply with the Scram program, and will be held without the right to bail until a Scram unit is available, and it was made available and installed on 11/10/17 and released on conditions of dangerousness. Continued to 1/3/18 for pretrial conference. Must pay legal counsel fee of $150.

Todd D. Wise Jr., 19, of Jones Road, Deerfield. Pleaded innocent to receiving a stolen motor vehicle, failure to stop for police, unlicensed operation of a motor vehicle, marked lanes violation, speeding at a rate of speed exceeding the posted limit, negligent operation of a motor vehicle, and failure to stop/yield in Montague. Released on personal recognizance. Continued to 1/4/18 for pretrial conference. Must pay legal counsel fee of $150 and $50 counsel contribution.

Philip T. Huff, 51, of Pittsfield, Found responsible for unlicensed operation of a motor vehicle in Shelburne by state police. Fined $100, to be paid by 12/15/17. Charge of uninsured motor vehicle dismissed on request of the Commonwealth.

James R. Frost, 40, of Solon Street, Greenfield. Pleaded innocent to assault and battery. Released on personal recognizance. Continued to 12/28/17 for pretrial conference.

Patrick J. Johnson, 54, of West Leyden Road, Colrain. Pleaded innocent to assault and battery in Greenfield. Released on personal recognizance. Continued to 12/28/17 for pretrial conference.

Stephen A. Bridges, 30, of South Main Street, South Deerfield. Pleaded innocent to operating under the influence of liquor or 0.08 percent, and marked lanes violation. Kanisha Trowell, 21, of Keene, N.H. Pleaded innocent to possessing a Class A drug, to wit, heroin, marked lanes violation, and violation of state highway traffic regulations. Released on personal recognizance. Continued to 1/4/18 for pretrial conference. Must pay legal counsel fee of $150.

Adrian O. Trout, 28, of East Hartford, Conn. Pleaded innocent to resisting arrest, violation of left lane restriction, failure to stop for police, and number plate violation in Greenfield by state police. Released on personal recognizance. Joan L. Brennan, 58, of Elm Terrace, Greenfield. Pleaded innocent to assault and battery on family/household member. Released on personal recognizance. Continued to 1/4/19 for pretrial conference. Must pay legal counsel fee of $150.

Barbara A. Cotelle, 49, of Wisdom Way, Greenfield. Charge of being the owner of, or the person in control of, a motor vehicle, did knowingly permit such vehicle to be operated by a person who was unlicensed or whose license had been suspended or revoked was dismissed on request of the Commonwealth.

Harry Kennedy, 22, of Gardner. Pleaded innocent to selling or delivering liquor to a person under 21, and improper storage of a firearm in Conway by state police. Released on personal recognizance. Continued to 1/5/18 for pretrial conference.

Thomas J. Carabine, 49, of West Springfield. Pleaded guilty to operating under the influence of liquor. Placed on probation until 11/6/18, with one-year loss of license, plus head-injury assessment of $250, OUI victims assessment of $50, and victim-witness assessment of $50. Must have no alcohol and subject to screens, and must attend and complete the Evergreen House program. Charge of possessing an open container of alcohol in a motor vehicle dismissed on request of the Commonwealth. Must pay probation supervision fee of $65 per month, but is waived while in the Evergreen program.

Joshua R. Savage, 33, of Gardner. Admitted to sufficient facts for operating a motor vehicle with license suspended in Sunderland by state police. Sufficient facts found, but continued without a finding until 2/7/18, with victim-witness assessment of $50. Found not responsible for a motorized scooter violation. Must pay legal counsel fee of $150. Must pay $50 per month probation supervision fee.

Jesse E. Davis, 45, of Amherst Road, in Sunderland by state police. Failure to register as a sex offender, but a special condition of release on this docket is that the defendant is to register as a sex offender properly. Continued to 1/3/18 for pretrial conference. Must pay legal counsel fee of $150.

Gisela M. Rrodriguez, 32, of Oak Courts, Greenfield. Pleaded innocent to assault and battery, and breaking and entering with intent to commit a misdemeanor. Released on personal recognizance, with special conditions. Must stay five yards away from and have no contact with the alleged victim. Continued to 1/3/18 for pretrial conference. Must pay legal counsel fee of $150.

Paul W. Penerian, 32, of North Main Street, Orange. Admitted to sufficient facts for assault and battery on family/household member. Sufficient facts found, but continued without a finding until 5/6/19, but must attend and complete the MOVE program with victim-witness assessment of $50. Charge of intimidating a witness, juror, police, or court official, disorderly conduct dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay $50 per month probation supervision fee, but it may be waived while the defendant is in the MOVE program.

Orange, Nov. 7, Judge David S. Ross

Ann J. Cote, 68, of Morton Meadows, Athol. Admitted to sufficient facts for charges of assault and battery on a police officer, and assault and battery. Sufficient facts found, in both, but continued without a finding until 5/7/18 for both. Charges of disorderly conduct, disturbing the peace, and of threatening to commit a crime, to wit, murder, were all dismissed on request of the Commonwealth. Charge of assault and battery on ambulance personnel, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, this was, in the interest of justice.

Jarrod E. Larhette, 31, of Miles Street, Greenfield. Pleaded innocent to operating a motor vehicle with license suspended, subsequent offense, operating with suspended registration, uninsured motor vehicle, and number plate violation to conceal identification in Erving. Released on personal recognizance. Continued to 2/6/18 for pretrial conference.

David M. Register, 23, of East Main Street, Orange. Charge of unlicensed operation of a motor vehicle to be dismissed on payment of $50 court costs, forthwith. Found not responsible for no inspection sticker.

Scott Modica, 23, of West River Street, Orange. Violation of an abuse prevention order, and intimidating a witness, juror, police, or court official. Bail set at $500 cash or $5,000 surety. Advised of right to bail review. Continued to 11/20/17 for pretrial conference.

Paul Taylor, 43, of Newton Street, Millers Falls. Pleaded innocent to unlicensed operation of a motor vehicle, and failure to stop/yield in Greenfield. Released on personal recognizance. Continued to 12/15/17 for pretrial conference.

Paul Taylor, 43, of Newton Street, Millers Falls. Pleaded innocent to unlicensed operation of a motor vehicle, and speeding, in Montague, different date from previous case, different town. Released on personal recognizance. Continued to 12/15/17 for pretrial conference.

Jessica M. Tuller, 34, of Montague City Road, Turners Falls. Admitted to sufficient facts to possessing a Class B drug, to wit, cocaine, in Deerfield by state police. Sufficient facts found. Must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Must have no drugs or alcohol, and subject to screens/tests. Found not responsible for improper operation of a motor vehicle, and having a motor vehicle that isn’t meeting Registry of Motor Vehicles safety standards.

Peter M. Falandes, 18, of Shelburne Falls Road, Conway. Pleaded innocent to breaking and entering a building in the nighttime with intent to commit a felony, and being a person under 21 in possession of liquor in Deerfield. Must have no alcohol and subject to screens and testing. Continued to 1/4/18 for pretrial conference. Must pay legal counsel fee of $150.

Donte L. Gardner, 21, of Pittsfield. Pleaded innocent to disorderly conduct, carrying a firearm without a license, possessing ammunition without a FID card, and carrying an unloaded rifle/shotgun on the way. Released on personal recognizance. Must have no drugs, and subject to screens. and must surrender all firearms and must not possess any firearms during this case, continued to 1/3/18 for pretrial conference. Must pay legal counsel fee of $150.

Ludmila Baraban, 30, of Woodleigh Avenue, Greenfield. Charge of assault and battery on family/household member was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after speaking with the victim (so named) the Commonwealth would be unable to meet the burden beyond a reasonable doubt. Must pay counsel fee of $150, or perform 16 hours of community service, and pay $150 counsel contribution.

Gabriel Wilson, 32, of Northampton. Pleaded guilty to larceny over $250, and was ordered to pay $50 restitution, that day. Must pay legal counsel fee of $150.

Greenfield, Nov. 9, Judge William Mazanec III

Pavel V. Krapova, 22, of Westfield. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent. Sufficient facts found, but continued without a finding until 11/8/18, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $726.80. Must have no alcohol and subject to screens and testing, Found not responsible for no inspection sticker. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month.

Ricky T. Rattanaviley, Admitted to sufficient facts for assault and battery on a police officer, and admitted to sufficient facts for resisting arrest. Sufficient facts found in both counts, but continued without a finding until 12/20/17 for pretrial conference. Must pay counsel fee of $150, or perform 16 hours of community service.
