Greenfield, March 10, Judge William Mazanec III

David F. Eklund, 43, of New Athol Road, Orange. Charge of leaving the scene of property damage, in Greenfield by state police, to be dismissed on payment of $2,500 restitution. Found not responsible for marked lanes violation.

Henry J. Brown Jr., 27, of Mount Hermon Station Road, Northfield, Charges of motor vehicle lights violation, and operating a motor vehicle with license suspended, were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the defendant didn’t appear to get proper notice of his license being suspended, and now has an active license.

Connor R. Zabko, 20, of Davis Street, Greenfield. Charges of negligent operation of a motor vehicle, and marked lanes violation, in Deerfield, dismissed prior to arraignment.

James R. Hubbard, 31, of Central Street, Turners Falls. Charge of operating with suspended registration, in Greenfield by state police, to be dismissed on payment of $50 court costs, and it was paid. Charge of uninsured motor vehicle, dismissed on request of the Commonwealth.

Monica M. Susskind, 57, of Florence. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent, in Greenfield by state police, but continued without a finding until 3/15/18, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $707.76. Restitution has yet to be determined. Found not responsible for marked lanes violation. Must pay probation supervision fee of $65 per month, or perform eight hours a month to community service.

Bryan T. Cook, 22, of Streeter Lane, Colrain. Charge of using a motor vehicle without authority, in Buckland, dismissed on request of the Commonwealth.

Arlene Algieri-Fontaine, 43, of Tulsa, Okla. Pleaded innocent to kidnapping, in Greenfield, released on personal recognizance, continued to 4/26/17 for pretrial conference. Must pay legal counsel fee of $150.

Benjamin J. Lawton-Curtis, 22, of Myrtle Street, Gill. Placed on pretrial probation until 6/16/17 for assault and battery, in Gill by state police.

Kevin C. Komosa, 35, of Keets Road, Deerfield. Charges of assault and battery with a dangerous weapon, to wit, personal weapons, assault and battery on a pregnant victim, and assault and battery on family/household member, were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the victim has asserted her marital privilege, and won’t testify; without her testimony, the Commonwealth can’t prosecute this charge.

Amanda L. Guppy, 30, of Union Street, Greenfield. Pleaded innocent to assault and battery on family/household member, resisting arrest, and assault and battery on a police officer, released on personal recognizance, continued to 4/26/17 for pretrial conference. Must pay legal counsel fee of $150.

Alaisiah Russell, 21, listed to a post box in Turners Falls. Pleaded innocent to malicious damage to a motor vehicle, and miscellaneous municipal ordinance or bylaw, to wit, having, or drinking from, an open container of alcohol in public, in Greenfield, released on personal recognizance, must stay away from and have no contact with a named alleged victim, and must have no alcohol and subject to screens, continued to 4/26/17 for pretrial conference. Must pay counsel fee of $150, or perform 16 hours of community service.

Pleaded innocent to negligent operation of a motor vehicle, marked lanes violation, and operating a motor vehicle with suspended license for operating under the influence of liquor, in Montague, released on personal recognizance, but must have no operation of a motor vehicle until it is allowed by the Registry of Motor Vehicles, continued to 4/28/17 for pretrial conference.

Jesse L. Johnson, 37, of West Townshend, Vt. Two charges of breaking and entering a building in the nighttime with intent to commit a felony, one charge of vandalizing property, and one of breaking and entering a vehicle or boat at nighttime with intent to commit a felony, in Bernardston, ordered held without right to bail, continued to 4/5/17 for pretrial conference.

Jeffrey R. Armes, 59, of Greenfield, Road, Deerfield. Pleaded innocent to operating under the influence of liquor or 0.08 percent, second offense, must have no alcohol and subject to screens and testing, must comply with the SCAM unit, must attend and complete an approved independent outpatient program, and must have no driving until the Registry of Motor Vehicles reinstates the license, continued to
4/26/17 for pretrial conference.

Sommer H. Cortes, 18, of Pray Drive, Greenfield. Pleaded innocent to malicious damage to a motor vehicle, released on personal recognizance, must stay 50 yards away from a named alleged victim, continued to 4/26/17 for pretrial conference.
