Susan Schroder: Galvin should act to disqualify Trump

This is my letter to Secretary Galvin, What’s yours?

Massachusetts is a leader. Following the state’s historical pattern, it makes sense that Massachusetts be the first state to act on disqualifying Donald Trump from being on the ballot for any state or federal office based on Section 3 of the 14th Amendment of the Constitution.

I have heard Judge Michael Luttig and Laurence Tribe talk about Section 3 of the 14th Amendment. I checked out “Cowboys for Trump” leader Couy Griffin’s August 2022 case in Olero County, New Mexico. Griffin was determined to be ineligible to hold any office in this county due to his participation in the Jan 6, 2021, attack on the Capitol, based on Section 3 of the 14th Amendment of the Constitution even though he had not entered the Capitol building.

I now understand that being a convicted felon does not make a person ineligible for public office. However, Section 3 of the 14th Amendment does.

There is not a great deal of time for this action to go through the courts before the 2024 election. The effort to disqualify Donald Trump from being on the ballot, any ballot in Massachusetts, and other states, will be challenged multiple times. Therefore, it is time to act now.

As fate would have it, you, Secretary Galvin, are the one in the position to make this happen. While this is a profound step, Massachusetts is very well suited to take it even though we know that Massachusetts would not vote for Trump. This is insignificant. Once Section 3 of the Constitution’s 14th Amendment is successfully honored in the courts, other states will follow. Having a state leader is crucial. Being the state leader is Massachusetts. Let’s do it!
