Charge of assault and battery on family/household member was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the named victim has stated that she can’t remember the events of that night; the commonwealth will be unable to meet it’s burden beyond a reasonable doubt.

Andrew Piela, 32, of River Road, Deerfield. Pleaded guilty to assault and battery with a dangerous weapon, to wit, a shod foot, different date from previous case. Sentenced to 18 months in the house of correction, direct, with credit for time held, and must return to court for GPS unit, after sentence is served. Pleaded guilty to assault and battery on family/household member. Sentenced to the same 18 months in the house of correction, concurrent with the first count, and also given credit for time held.

Tevin Daniels, 23, of L Street, Turners Falls. Admitted to sufficient facts for having operated a motor vehicle after the license to operate a motor vehicle had been revoked by reason of his or her having been found to be an habitual traffic offender. Sufficient facts found, but continued without a finding until 2/22/19, with administrative probation. Must pay legal counsel fee of $150. Must pay $50 per month probation supervision fee, or perform four hours per month community service.

Joshua R. Hubbard, 31, of Shelburne Falls Road, Conway. Charge of operating under the influence of liquor or 0.08 percent, second offense, by Conway Police was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after review of all facts and evidence available in this case, the commonwealth couldn’t sustain it’s burden to this charge; the defendant is pleading to negligent operation of a motor vehicle, which is appropriate, given the circumstances. Admitted to sufficient facts for negligent operation of a motor vehicle.
