Admitted to sufficient facts for assault and battery, amended down from assault and battery with a dangerous weapon, to wit, a knife, but continued without a finding until 10/25/16, with victim witness assessment of $50, and must have no alcohol, and subject to testing. Greenfield, April 27, Judge Paul Smyth

Cynthia Loyd, 54, of Brattleboro, Vt. Found responsible for unlicensed operation of a motor vehicle in Bernardston by state police, fined $50, and decriminalized, to wit, converted to a civil complaint.

Marina S. Pirozhkov, 24, of Elm Street, Greenfield. Charge of being an operator refusing to identify his or her self, to be dismissed on payment of $50 court costs. Charge of unlicensed operation of a motor vehicle, also to be dismissed on payment of $50 court costs.

Sean P. Martin, 26, of Whately Road, South Deerfield. Pleaded innocent to operating under the influence of liquor, and speeding, in Deerfield, released on personal recognizance, continued to 5/26/16 for pretrial conference. Must pay $150 legal counsel fee.

Carmelo Torres Jr. 35, of Winchester, N.H. Admitted to sufficient facts for larceny under $250 value, amended down from larceny over $250, fined $250 plus victim witness assessment of $50.

Jesse A. James, 37, of North Cross Road, Gill. Admitted to sufficient facts for possession of a Class A drug, to wit, heroin, sentenced to 9 months in the house of correction, direct, with recommendation that it be spent at Howard Street facility in Springfield, and given credit for time held. Must provide a DNA sample to the state data bank.

Jason J. Betinis, 56, of East Hawley Road, Charlemont. Pleaded innocent to malicious destruction of property over $250 value, disorderly conduct, two charges of threatening to commit a crime, to wit, murder in the first charge, and assault and battery with a dangerous weapon, in the second charge, and a separate charge of assault and battery with a dangerous weapon, to wit, a stick, released on personal recognizance, continued to 6/7/16 for pretrial conference. Must pay $150 legal counsel fee, and $100 legal counsel contribution,

Joshua D. Hastings, 32, of Turnpike Road, Turners Falls Pleaded innocent to failure to stop for police, operating under the influence of liquor, negligent operation of a motor vehicle, and speeding, in Deerfield, released on personal recognizance, continued to 5/26/16 for pretrial conference. Thomas J. Gilson, 25, of Hope Street, Greenfield. Pleaded innocent to operating with suspended license, in Northfield, released on personal recognizance, continued to 7/29/16 for pretrial conference.

Joseph A. Hayward, 57, of Wells Street, Greenfield, Pleaded innocent to two charges of assault with a dangerous weapon, to wit, a knife in both charges, but involving two different people, released on personal recognizance, must stay away from and have no contact with the named victims, and must refrain from carrying a knife or pocket knife pending this case, continued to 5/31/16 for pretrial conference. Must pay $150 legal counsel fee, or perform 16 hours community service.

Luis Vazquez-Otero, 36, of Bronx, N.Y. Admitted to sufficient facts for operating under the influence of liquor, in Northfield, but continued without a finding until 4/26/17, with 45-day mandatory loss of license, plus $250 head injury assessment, OUI fee of $250, OUI victim’s assessment of $50, and victim witness fee of $50. Must take and complete the driver alcohol education program, and pay the fee of $707.76. Found not responsible for marked lanes violation and possessing an open container of alcohol in a motor vehicle. Must pay $150 legal counsel fee. Must pay $65 per month probation supervision fee. Charge of negligent operation of a motor vehicle dismissed on request of the Commonwealth.

Orange, April 27, Judge David S. Ross

Ernest Cumberbatch, 64, of Unity Avenue, Athol. Pleaded guilty to assault and battery, amended down from indecent assault and battery on a person 14 or over, placed on probation until 4/27/18 must have no drugs or alcohol, subject to screens/tests, must stay 50 yards away from and have no contact with the victim, and must have sex offender counseling. Pleaded guilty to a second charge of assault and battery, sentenced to two years in the house of correction, suspended, placed on probation until 4/27/18, with the same conditions as in the first count. Charges of attempting to commit a crime, to wit, rape, and attempt to rape, were not prosecuted, as according to a written statement from a counsel in the district attorney’s office, the remaining charges will be prosecuted in district court. Admitted to sufficient facts for intimidating a witness, a juror, police or court official, but continued without a finding until 4/27/18, with victim witness assessment of $90. Must pay $150 legal counsel fee. Must pay $65 per month probation supervision fee.

Greenfield, April 28, Judge William Mazanec III

Daniel Marry, 35, of Hinsdale, N.H. Pleaded guilty to unlicensed operation of a motor vehicle, fined $200, plus $100 surfine, Found not responsible for motor vehicle lights violation. Charge of being present where heroin is kept, dismissed on request of the Commonwealth. Must pay $150 legal counsel fee.

Robert W. Rogers, 27, of School Street, Greenfield. Pleaded innocent to assault and battery with a dangerous weapon, to wit, a broom, assault and battery, home invasion, breaking and entering into a building in the nighttime with intent to commit a felony, and vandalizing property, bail set at $5,000 cash or $50,000 surety, continued to 5/23/16 for pretrial conference.

John A. Chapin, 70, of Randall Drive, Guilford, Vt. Charge of operating with suspended license, in Leyden, to be dismissed on payment of $50 court costs. Found responsible for marked lanes violation, fined $100. Charge of speeding, charge of negligent operation of a motor vehicle, dismissed on request of the Commonwealth. Found responsible for speeding, fined $50, plus head injury assessment of $50.

Robert F. Knight, 46, of Chapman Court, Greenfield. Pleaded guilty to operating with suspended license, in Greenfield by state police, fined $200, plus $50 surfine. Found not responsible for operating or owning a motor vehicle that doesn’t meet the safety regulations of the Registry of Motor Vehicles. Must pay $150 legal counsel fee.

Christopher Boucher, 29, of Swanzey, N.H. Charge of carrying a dangerous weapon, in Bernardston by state police, to wit, a knife, to be dismissed on payment of $100 court costs. Found responsible for miscellaneous motor vehicle equipment violation, fined $35. Must pay $150 legal counsel fee.

Greenfield, April 28, Judge Laurie MacLeod

Brian M. Giesing, 25, of Southwick. Admitted to sufficient facts for negligent operation of a motor vehicle, but continued without a finding until 10/25/16, and must take driver safety course. Charges of operating with suspended license, number plate violation to conceal identification, and taking another person’s number plate, were all dismissed on request of the Commonwealth. Found not responsible for no inspection sticker. Must pay $50 per month probation supervision fee.

Courtney J. Rowland, 24, of Main Street, Northfield. Charge of number plate violation to conceal identification, dismissed on request of the Commonwealth.

Stanley Woodbury, 27, of Grove Street, Orange. Admitted to sufficient facts for negligent operation of a motor vehicle, in Greenfield, but continued without a finding until 10/28/16, with victim witness assessment of $50, and concurrent with sentence in another case and must take safe driver course. Found not responsible for speeding, and failure to wear a seat belt, and marked lanes violation. Must pay $50 per month probation supervision fee, unless paying in another court.

Albert J. Hildreth, Pleaded innocent to being a fugitive from justice on a court warrant, for larceny and breaking and entering, in North Carolina, bail set at $100,000 bail continued to 5/20/16 for pretrial conference.

Karen A. Sanders, 69, of Greenfield, Road, Turners Falls. Admitted to sufficient facts for motor vehicle homicide by negligent operation, fined $250, plus $50 surfine, with victim witness assessment of $50, placed on probation until 5/2/17, and no operation of a motor vehicle until the Registry of Motor Vehicles reinstates the license. Must pay $50 per month probation supervision fee.

Must pay $65 per month probation supervision fee.

Nicole Archambo, 29, of Clement Street, Buckland. Found responsible for no inspection sticker, in Shelburne, fined $50. Found not responsible for speeding. Charge of leaving the scene of property damage, dismissed on request of the Commonwealth.

Joseph B. Cook, 37, of Depot Street, Monroe Bridge. Pleaded innocent to operating with suspended registration, uninsured motor vehicle, and unregistered motor vehicle, in Greenfield, released on personal recognizance, continued to 5/11/16 for pretrial conference.

Steven Jackman, 20, of Bayberry Court, Greenfield. Pleaded innocent to malicious destruction of property under $250 value, amended down from malicious damage to a motor vehicle, released on personal recognizance, continued to 6/9/16 for pretrial conference. Must pay $150 legal counsel fee.

Eric Wheeler, 30, listed as homeless, of Greenfield. Charge of failure to register as a sex offender, was not prosecuted, as according to a written statement from a counsel in the district attorney’s office, the defendant’s guilty plea on a related case out of Orange District Court was accepted by the court, and this nolle prosequi is filed as part of plea negotiations.

Joseph A. Fleming, 38, of Parmenter Road, Bernardston. Pleaded innocent to unlicensed operation of a motor vehicle, and being the owner or person in control of a motor vehicle who permitted such vehicle to be operated by a person who was unlicensed or whose license had been suspended or revoked, in Gill by state police, released on personal recognizance, continued to 7/8/16 for pretrial conference.
