Greenfield, Dec. 18, Judge William Mazanec

Robert I. Waller, 30, of G Street, Turners Falls. Pleaded innocent to two counts of assault and battery, one charge of disorderly conduct, and one of disturbing the peace, held for dangerousness hearing on Dec. 19, and after the motion for pretrial detention was allowed, the case was continued to 2/4/14 for pretrial conference.

Greenfield, Dec. 19, Judge Laurie MacLeod

Jose L. Rodriguez, 27, of Fourth Street, Turners Falls. Charge of assault and battery with a dangerous weapon, to wit, a knife, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the defendant was found to be incompetent to stand trial, by a court decision.

Jose Luis Rodriguez, 27, of Fourth Street, Turners Falls. Three charges of assault with a dangerous weapon, to wit, a knife in each count, and resisting arrest, in Greenfield, were not prosecuted from a counsel on the district attorney’s staff, for the same reason as in previous case.

Emberly F. Sobieski, 24, of Heath Road, Colrain. Admitted to sufficient facts for operating under the influence of liquor, in Greenfield, but continued without a finding until 12/18/14, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victim’s assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $567.22. Must have substance abuse evaluation, and take any follow up treatment recommended by probation, and must continue with counseling. Admitted to sufficient facts for possession of class A drug, to wit, heroin, and two counts of assault and battery, but continued without a finding on each of the three charges until 12/18/14. Pleaded guilty to possession of chemical mace without firearms identification card, filed with defendant’s consent. Found not responsible for possessing/having an open container of alcohol in a motor vehicle. Charge of negligent operation of a motor vehicle, and malicious damage to a motor vehicle, both dismissed at request of the commonwealth. Must pay legal counsel fee of $150. Must pay $50 default warrant fee. Must pay $65 per month probation supervision fee.

Enrique Ovalle, 37, of Madison Avenue, Turners Falls. Admitted to sufficient facts for operating with suspended license, in Shelburne by state police, amended down from subsequence offense, fined $500. Found responsible for marked lane violation, filed with defendant’s consent. Found not responsible for miscellaneous motor vehicle equipment violation.

Enrique Ovalle, 37, of Madison Avenue, Turners Falls. Found not responsible for marked lane violation, in Shelburne by state police, different date from previous case. Charges of operating with suspended registration, subsequence offense, and no registration in possession, both dismissed at request of the commonwealth.

Greenfield, Dec. 20, Judge William Mazanec

Alicia M. Brown, 28, of Brattleboro, Vt. Found responsible for number plate violation, fined $35. Charge of operating with suspended license, in Greenfield by state police, dismissed at request of the commonwealth. Found not responsible for no registration in possession, and speeding.

Dionne Cendrowski, 30, of Wendell Road, Shutesbury. Charge of uninsured motor vehicle, in Greenfield by state police, to be dismissed on payment of $25 court costs. Charge of operating with suspended registration, dismissed at request of the commonwealth. Found not responsible for no inspection sticker.

Jordan J. Russ, 25, listed to a post box, in Bernardston. Admitted to sufficient facts for negligent operation of a motor vehicle, amended down from reckless operations of a motor vehicle, in Whately, but continued without a finding until 2/1/14 with, head injury assessment of $250, and victim witness assessment of $50. Must pay total of $300 probation supervision fee.

Austin S. White, 25, of Farley Road, Wendell. Pleaded innocent to operating under the influence of liquor, unregistered motor vehicle, marked lane violation, and negligent operation of a motor vehicle, in Greenfield, released on personal recognizance, continued to 1/23/14 for pretrial conference. And appearance of counsel.

Paul A. Giard, 49, of Purinton Lane, Colrain. Pleaded innocent to assault and battery, in Colrain by state police, released on personal recognizance, must have no abuse of the alleged victim, continued to 2/4/14 for pretrial conference. Must pay legal counsel fee of $150.

Corinne A. Boucher, 34, of West Springfield. Pleaded innocent to larceny over $250, in Deerfield, released on personal recognizance, continued to 1/30/14 for pretrial conference. Must pay legal counsel fee of $150.

Patrick N. Colvin, 28, of Bernardston Road, Greenfield. Pleaded innocent to motor vehicle lights violation, and unlicensed operation of a motor vehicle, in Bernardston, released on personal recognizance, continued to 2/25/14 for pretrial conference.

Pleaded innocent to unlicensed operation of a motor vehicle, and failure to drive in the right lane, in Greenfield by state police, different date from previous case, released on personal recognizance, continued to 2/25/14 for pretrial conference.

Heather George, 26, of Turners Falls Road, Turners Falls. Pleaded innocent to malicious destruction of property over $250 value, in Greenfield, released on personal recognizance, continued to 1/30/13 for pretrial conference. Must pay legal counsel fee of $150.

Christopher M. Passon, 24, of Riverside Drive, Greenfield. Pleaded innocent to assault and battery, and wanton destruction of property under $250, released on personal recognizance, continued to 2/4/14 for pretrial conference. Must pay legal counsel fee of $150.

Brian M. Peltier, 38, of Hadley. Pleaded innocent to operating under the influence of liquor, negligent operation of a motor vehicle, assault and battery on a police officer, resisting arrest, and attempt to commit a crime, to wit, malicious destruction of property, in Sunderland, released on personal recognizance, continued to 1/30/14 for pretrial conference. Must pay legal counsel fee of $150, and $50 legal counsel contribution.
