Greenfield, Nov. 2, Judge Laurie MacLeod

Janessa M. Caisse, 18, of Winthrop Street, Millers Falls. Charges of assault and battery, and wanton destruction of property under $250, were both dismissed at request of the victim with accord and satisfaction accepted by the judge. A $150 legal counsel fee has been paid.

Greenfield, Nov. 18, Judge Michael Ripps

James C. Burke, 45, of Denton Street, Lake Pleasant. Charge of unlicensed operation of a motor vehicle, to be dismissed on payment of $50 court costs. Found not responsible for speeding.

Thomas Nater, 34, of Main Street, Greenfield. Charge of unlicensed operation of a motor vehicle, in Montague, to be dismissed on payment of $25 court costs. Found responsible for having a child under 8 years old and under 58 inches tall without a car seat, fined $25. Found not responsible for no inspection sticker, and speeding.

Theodore J. Burrell, 45, of Shelburne Road, Greenfield. Found innocent, following a jury trial, for indecent assault and battery on a person 14 or over, and indecent exposure.

Greenfield, Nov. 19, Judge Maureen Walsh

Raymond P. Sokoloski, 62, of Mount Hermon Station Road, Northfield. Pleaded innocent to assault and battery, released on personal recognizance, must have no abuse of the alleged victim, continued to 12/17/13 for pre-trial conference.

James O. Sanchez, 22, of Hayes Avenue, Greenfield. Pleaded innocent to operating with suspended license, released on personal recognizance, continued to 12/17/13 for pre-trial conference.

Peter Vonschmidt, 27, of Harrison Avenue, Greenfield. Charge of operating with suspended license, to be dismissed on payment of victim witness assessment of $50.

Sarah A. Lopez, 34, of G Street, Turners Falls. Pleaded innocent to operating with suspended license for operating under the influence of liquor, uninsured motor vehicle, operating with suspended registration, and no inspection sticker, released on personal recognizance, continued to 12/24/13 for pre-trial conference. Must pay legal counsel fee of $150.

Kelvin J. Smith, 23, of West Main Street, Millers Falls. Admitted to sufficient facts for disorderly conduct, in Greenfield, fined $50 with $50 surfine, with alternative to perform 10 hours community service. There is also a victim witness assessment of $50.

Christel Lynn Thibodaux, 34, of Wells Street, Greenfield. Charge of assault and battery, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the alleged victim has asserted a valid Fifth Amendment privilege and the commonwealth cannot proceed without his testimony.

Greenfield, Nov. 19, Judge William Mazanec

Santo Luis Bones, 26, of Phillips Street, Greenfield. Charges of violation of miscellaneous municipal ordinance or by law, trespassing on public land, negligent operation of a motor vehicle, speeding, being an operator refusing to identify him- or herself, failure to stop or yield, and operating with suspended license, subsequence offense, were not prosecuted, as according to a written statement from a counsel on the district attorney’s staff, the reporting party didn’t appear on the trial day, and the commonwealth cannot prove this case without her testimony.

Greenfield, Nov. 20, Judge William Mazanec

Sabine Menard, 53, of Alden Street, Greenfield. Admitted to sufficient facts for operating under the influence of liquor, but continued without a finding until 11/19/14, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $567.22. Found not responsible for possessing/having an open container of alcohol in a motor vehicle. Must pay legal counsel fee of $150, or perform 16 hours community service. Must pay $65 per month probation supervision fee.

Robert Joseph O’Brien, 40, of Leeds. Charges of operating under the influence of liquor, failure to wear a seat belt, for possessing/having an open container of alcohol in a motor vehicle, and speeding, in Whately, were not prosecuted as, according to a written statement from a counsel on the district attorney’s staff, the entire complaint has been replaced by another case. Domingo E. Cook, 43, of Kansas City, Charge of operating with suspended license, in Bernardston by state police, to be dismissed on payment of $50 court costs, on a case from 3/27/2006. Found not responsible for speeding.

Greenfield, Nov. 20 Judge Charles W. Groce III

Shanna E. Swan, 28, of Mechanic Street, Shelburne Falls. Admitted to sufficient facts for identity fraud, placed on probation until 6/17/15, with $90 victim witness assessment, must continue counseling and must sign releases so probation office can monitor attendance at any program ordered by the court, must have no alcohol, subject to testing/screens, and TV to be forfeited, and must have no contact with the named victim. Eight more charges of identity fraud, were all dismissed at request of the commonwealth. Defendant was placed on probation until 6/17/15 for credit card fraud over $250, with same conditions as in first count. Two additional charges of credit card fraud over $250, were dismissed at request of the commonwealth. Must pay $65 per month probation supervision fee or perform eight hours per month community service.

Jacque Coleman, 24, of Main Street, Greenfield. Pleaded innocent to wanton destruction of property over $250, and assault and battery, bail set at $100 cash, continued to 12/17/13 for pre-trial conference.

Kelly M. Wardynski, 26, of Thayer Street, South Deerfield. Pleaded innocent to possessing a counterfeit note, uttering a counterfeit note, larceny under $250 by false pretense, and attempt to commit a crime, to wit, larceny under $250, released on personal recognizance, continued to 12/16/13 for pre-trial conference. Must pay legal counsel fee of $150.

Oliver V. Richards, 23, of Russell Street, Greenfield. Pleaded innocent to violation of an abuse prevention order, unarmed robbery, indecent assault and battery on a person 14 or over, and assault and battery, bail set at $1,000 cash or $10,000 surety, continued to 12/19/13 for bind over hearing. Must pay legal counsel fee of $150.

Must pay legal counsel fee of $150.

Candace M. Caswell, 33, of School Street, Buckland. Charge of operating with suspended license, in Shelburne, dismissed at request of the commonwealth.

Peter R. Ruhf, 66, of Bridge Street, Shelburne Falls. Charge of operating with suspended license, to be dismissed on payment of $25 court costs.

Edward Hurlburt III, 38, of Goshen. Admitted to sufficient facts for operating under the influence of liquor, operating under the influence of liquor, but continued without a finding until 11/20/14, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $567.22 . Charges of negligent operation of a motor vehicle, and resisting arrest, dismissed at request of the commonwealth. Found not responsible for marked lane violation, Found responsible for failure to wear a seat belt, filed with defendant’s consent Must pay legal counsel fee of $150, and $50 legal counsel contribution. Must pay $65 per month probation supervision fee.

Brian Heath, 28, of French King Highway, Gill. Admitted to sufficient facts for operating under the influence of liquor, but continued without a finding until 11/20/14, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $567.22. Found not responsible for speeding in violation of special regulations, and no inspection sticker. Charges of possession of class B drug, to wit, methadone, with intent to distribute, possession of class A drug, to wit, morphine, with intent to distribute, and possession of a class E drug, to wit, Trazodone, with intent to distribute, were all moved to 1/6/14 for hearing in drug court. Must pay legal counsel fee of $150, and $350 legal counsel contribution. Must pay $65 per month probation supervision fee.

Jacobo Bartolon, 32, of Aster Court, Greenfield. Pleaded guilty to operating with suspended license, amended down from operating with suspended license, subsequence offense, fined $500 and it has been paid. Must pay legal counsel fee of $150, and $150 legal counsel contribution.

Ray Martinez, 28, of Severence Street, Greenfield. Charge of operating with suspended registration, in Greenfield by state police, to be dismissed on payment of $100 court costs. Charge of uninsured motor vehicle, dismissed at request of the commonwealth.

Chester Sinclair, 65, of Main Street, Northfield. Pleaded innocent to operating under the influence of liquor, for possessing/having an open container of alcohol in a motor vehicle, and no registration in possession, in Gill, released on personal recognizance, continued to 1/6/14 for pre-trial conference.
