Must have substance abuse evaluation, and take any follow up treatment recommended by probation. Must have no drugs or alcohol, subject to testing/screens, and must take and complete the MOVE batterer’s program, and must have no abuse of the victim. Pleaded guilty to threatening to commit a crime, to wit, murder, and placed on probation until 11/3/14, concurrent with the probation term in count one. Charge of disorderly conduct, dismissed at request of the commonwealth. Must pay legal counsel fee of $150, or perform 16 hours community service. Must pay $65 per month probation supervision fee or perform eight hours per month community service, but may be offset by payments being made to MOVE.

James R. Kelley, 24, of Fourth Street, Turners Falls. Admitted to sufficient facts for aggravated assault and battery, but continued without a finding until 5/1/15, must have no abuse of the victim, must take and complete the Reflections program, must have substance abuse evaluation, and take any follow up treatment recommended by probation, must have no drugs or alcohol, subject to testing/screens, and defendant is to report twice a week to probation office for screens until he is in the Reflections program. Charges of violation of an abuse prevention order, and intimidating a witness, were continued without a finding on both until 5/1/15, with same conditions as in count one. Must pay $65 per month probation supervision fee, but may be waived while in program.

Daniel J. Scully, 39, of High Street, Greenfield. Admitted to sufficient facts for operating under the influence of liquor, but continued without a finding until 5/1/15 with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $567.22. Admitted to sufficient facts for negligent operation of a motor vehicle, but continued without a finding until 5/1/15. Found not responsible for marked lane violation. Must pay legal counsel fee of $150. Must pay $65 per month probation supervision fee.

William Schoedel, 68, of Oak Street, Gill. Pleaded guilty to possessing child pornography, placed on probation until 5/1/15 with $90 victim witness assessment, and must enter and complete a sex offender treatment program, must have no Internet service at his residence, no Internet use at private or public wi-fi sites, and the defendant shall surrender any computer, tablet or smartphone for inspection by the probation department, and no supervised contact with any child under the age of 16. Must provide a DNA sample to the state police data center. Must pay $65 per month probation supervision fee.

Charges of possession of class B drug, to wit, cocaine, and conspiracy to violate drug laws, were not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the commonwealth can’t go forward with evidence it has at this time.

Shawn M. Coleman, 22, of Packard Road, Orange. Charge of assault and battery, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the victim was unable to be located, and therefore the commonwealth cannot proceed.

Alex M. Molaro, 34, of Jamaica, N.Y. Charges of possession of class B drug, to wit, crystal meth, with intent to distribute, second charge of possession of class B drug, to wit, PCP, with intent to distribute, possession of drug paraphernalia with intent to distribute, and conspiracy to violate drug laws, were not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the defendant is currently incarcerated in New York State awaiting sentencing on an armed robbery; he is facing a significant sentence there; while the commonwealth is confident that it could establish a prima facie case against the defendant on this complaint, it declines to further prosecute on these charges, based on a consideration of the cost of bringing the defendant to trial, and given that the co-defendants each received jail sentences of 22 days.

Michael R. Boyer, 24, of Chapman Street, Greenfield. Pleaded guilty to threatening to commit a crime, to wit, murder, sentenced to six-months in the house of correction, direct, concurrent with a sentence in superior court. Pleaded guilty to disorderly conduct, filed with defendant’s consent. Charges of breaking and entering a building in the daytime with intent to commit a felony, to wit, putting a person in fear, and malicious destruction of property over $250 value, were dismissed at request of the commonwealth.
