Admitted to sufficient facts for operating under the influence of liquor, but continued without a finding until 4/7/14, with 45-day mandatory loss of license, plus OUI fee of $250, OUI assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the cost of $567.22, and must have no drugs or alcohol, subject to random testing, Pleaded guilty to leaving the scene of property damage, and using a motor vehicle without authority, sentenced to one-year in the house of correction on each charge, both suspended, and placed on probation until 4/7/14, with same conditions as in the first count. Two charges of forgery of a check, dismissed at request of the commonwealth. Admitted to sufficient facts for two charges of uttering a false check, but continued without a finding until 4/7/14, with victim witness assessment of $50 on the first such charge, and must have no contact with the alleged victim and must write a letter of apology to the victim. Admitted to sufficient facts for attempt to commit a crime, to wit, larceny over $250, but continued without a finding until 4/7/14. Must pay $65 per month probation supervision fee.

Kimberly A. Jones, 25, of Chapman Court, Greenfield. Charge of assault and battery, was not prosecuted as, according to a written statement from the district attorney’s office, the victim is asserting his marital privilege, and without his testimony the commonwealth can’t go forward on this charge.

Earl D. MacDonald, 42, of East Haven, Ct. Found responsible for violation of miscellaneous motor vehicle equipment regulations, fined $35. Charge of operating with suspended registration, dismissed at request of the commonwealth.

Jesse E. Davis, 40, of Old Amherst Road, Sunderland. Pleaded innocent to two counts of rape and one of assault and battery, in Greenfield, released on personal recognizance, must stay 50 yards away from and have no contact with the alleged victim, and stay away from wherever she may live, continued until 5/7/13 for bind over hearing. Must pay legal counsel fee of $150.

Kari L. Bailey, 27, of Third Street, Turners Falls. Charge of possession of marijuana, to be dismissed on payment of $100 court costs. Admitted to sufficient facts for possession of a Class B drug, to wit, cocaine, but continued without a finding until 10/8/13, plus victim witness assessment of $50. Must take and complete 14-day in-patient residential driver alcohol education program at cost of $953.76, and must take any treatment recommended from and after the program. Must have no drugs or alcohol, subject to random testing, must have electronic monitoring, and Sobrietor equipment to be renewed in June. Lori A. Sutherland, 36, of Main Street, Athol.
