Orange, March 3, Judge David S. Ross

Dale Draves, 34, of Old Keene Road, Athol. Pleaded guilty to assault and battery, amended down from aggravated assault and battery, sentenced to two years in the house of correction, direct, and given 69 days credit for time served. Pleaded guilty to assault, and sentenced to the same two years in the house of correction, and concurrent with count one. Pleaded guilty to violation of an abuse prevention order, sentenced to two years in the house of correction, suspended, placed on probation until 3/4/16 on condition of having no contact with the victim, with victim witness assessment of $50, must take medications as prescribed, must take and complete a certified anti-batterer’s program, and must have mental health evaluation according to state law, and take any after care recommended.

Pleaded guilty to two charges of assault and battery on a police officer, and a second charge of assault, and placed on probation on all three until 3/4/16. Charge of civil rights violation, and intimidating a witness, juror, police, or court official, both dismissed at request of the commonwealth. Pleaded guilty to assault and battery, placed on probation until 3/4/16. Pleaded guilty to three charges of threatening to commit a crime, to wit, murder in the first two charges and assault and battery, in the third, placed on probation until 3/4/16 on all three counts. Must pay $65 per month probation supervision fee, once released from the two year sentences in the house of correction.

Greenfield, March 4, Judge William Mazanec

Lance L. Lichtenberger, 38, of South Main Street, Athol. Pleaded innocent to operating under the influence of liquor, using a motor vehicle in commission of a felony/larceny, negligent operation of a motor vehicle, failure to stop for police, assault with a dangerous weapon, to wit, resisting arrest, tire tread depth violation, marked lane violation, failure to slow, speeding in violation of special regulations, and violation of state highway traffic regulations, released on personal recognizance, must have no drugs or alcohol, subject to random testing/screens, and ordered not to drive a motor vehicle until the Registry of Motor Vehicles reinstates the license. Must pay legal counsel fee of $150, and $150 legal counsel contribution.

Jose L. Hernandez-Toro, 32, of Westborough. Found responsible for unlicensed operation of a motor vehicle, in Erving by state police, fined $50, to be paid forthwith, and decriminalized, to wit, converted to a civil complaint.

Alissa A. Niall, 28, of East River Street, Orange. Charge of operating with suspended license, to be dismissed on payment of $50 court costs. Found not responsible for miscellaneous motor vehicle equipment violation.

Paul Cushing, 29, of Fitchburg. Charges of uninsured motor vehicle, unregistered motor vehicle, and number plate violation to conceal identification, in Erving, were not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, as the defendant paid his dealership to register the vehicle and transfer of the plate.

Christopher R. Stevens, 32, of West Main Street, Erving. Pleaded innocent to operating with suspended license, subsequence offense, released on personal recognizance, continued to 5/6/14 for pre-trial conference.

Scott F. Fournier, 37, of Orange Road, Warwick. Charges of uninsured motor vehicle, unregistered motor vehicle, and number plate violation to conceal identification, were not prosecuted, according to a written statement from a counsel on the district attorney’s staff, in the interest of justice based on information known at this time.

Lisa M. Brooks-Hatch, 43, of Prospect Street, Athol. Pleaded innocent to improper storage of a firearm, possessing a firearm without a firearms identification card, released on personal recognizance, and must posses no firearms, continued to 4/18/14 for pre-trial conference. Must pay legal counsel fee of $150, or perform 16 hours community service.

Jeremiah, S. Wawizyniak, 23, of Millers Falls Road, Turners Falls. Pleaded innocent to two charges of assault and battery with a dangerous weapon, to wit, a shod foot in both charges, and mayhem, in Erving, bail set at $300 cash, continued to 4/7/14 for pre-trial conference. Defendant must stay away from and have no contact with the alleged victim, and must have no abuse of the alleged victim, and must have no alcohol, subject to testing.

Daniel V. Saunders, 53, of Main Street, Athol. Pleaded innocent to assault with a dangerous weapon, to wit, a shod foot, bail set at $1,000 personal surety, continued to 4/18/14 for pre-trial conference. Must pay legal counsel fee of $150, or perform 16 hours community service. Conditions set for release are, must have no alcohol, subject to testing, and must stay away from and have no contact with the alleged victim.

Justin Smith, 27, of Swamp Road, Erving. Charge of operating with suspended license, to be dismissed on payment of $50 court costs. Charges of operating with suspended registration, and uninsured motor vehicle, both dismissed at request of the commonwealth.

Joseph C. Brooks, 76, of Summer Street, Athol. Admitted to sufficient facts for violation of an abuse prevention order, but continued without a finding until 8/4/14, with same conditions as in a sentence in another case. Must have mental health evaluation according to state law, and take any after care recommended, and must stay away from and have no contact with the victim. Must pay legal counsel fee of $150, or perform 16 hours community service.

Robert Moore, 30, of Royalston Road, Orange. Charge of assault and battery, in Athol, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the only witness in this case claims there was no physical contact between the defendant and the victim; the commonwealth can’t prove the offence charged at this time.

Tywan M. Dean, 35, of Cottage Street, Athol. Pleaded guilty to larceny over $250, in Orange, placed on probation until 9/11/15, with $90 victim witness assessment, and must complete the drug court program. Must make restitution of $360.97. Pleaded guilty to unlicensed operation of a motor vehicle, filed with defendant’s consent until 9/11/15. Must pay legal counsel fee of $150. Must pay $65 per month probation supervision fee or perform eight hours per month community service.

Billy J. Cote, 37, of Fish Street, Athol. Pleaded guilty to violation of an harassment prevention order, placed on probation until 3/10/15, with victim witness assessment of $50, and must continue wearing a GPS for 90 days or until 6/10/14, must continue mental health counseling, and must have no drugs or alcohol, subject to random testing/screens. Must pay legal counsel fee of $150, or perform 16 hours community service. Must pay $65 per month probation supervision fee.

Kristina Churchill, 31, of French King Highway, Erving. Pleaded innocent to operating with suspended license, released on personal recognizance, continued to 4/11/14 for pre-trial conference.

Pleaded innocent to resisting arrest, and carrying a dangerous weapon, to wit, a spring assisted knife, released on personal recognizance, continued to 4/14/14 for pre-trial conference. Randy Shaw, 24, of Lake Street, Athol. Pleaded innocent to operating with suspended license, failure to wear a seat belt, possession of Class B drug, to wit, Percocet, released on personal recognizance, continued to 4/14/14 for pre-trial conference. Daniel L. Bowie, 34, of Owings Mills, Md. Pleaded innocent to two charges of being a fugitive from justice on a court warrant, one for bigamy, in New Hampshire, and one for terrorizing and criminal mischief in Maine, bail set at $100,000 cash and $1,000,000 surety, case continued to 3/24/14 for pre-trial conference.

Darren J. LeBlanc, 48, of South Street Athol. Pleaded innocent to distributing a Class B drug, to wit, Suboxone, in Greenfield, by state police, released on personal recognizance, continued to 3/20/14 for pre-trial conference.

Michael Holloway, 54, of East Hill Road, Bernardston. Pleaded innocent to assault and battery, and intimidating a witness, juror, police, or court official, released on personal recognizance, and must abide by 209A restraining order, continued to 4/17/14 for pre-trial conference.

Destine C. Wright, 21, of Phillips Street, Greenfield. Admitted to sufficient facts for operating under the influence of liquor, but continued without a finding until 3/9/15, with 210 day loss of license, plus OUI fee of $250, OUI victims assessment of $50, head injury assessment of $250, and victim witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $567.22. Found not responsible for speeding.

Matthew Collaro, 24, of Amherst Road, Sunderland. Pleaded innocent to assault and battery, intimidating a witness, juror, police, or court official, bail set at $100, cash, by agreement, continued to 4/9/14 for pre-trial conference.

Jonathan C. Crowningshield, 19, of Gerrish Road, Northfield. Pleaded innocent to operating under the influence of liquor, and negligent operation of a motor vehicle, in Northfield by Bernardston Police, released on personal recognizance, must have no alcohol, subject to random testing, and must not drive, and must surrender the driver’s license to the probation officer, pending the outcome of this case, continued to 3/21/14 for pre-trial conference. David R. Berry, 39, of East Main Street, Orange. Pleaded innocent to violation of an abuse prevention order, and following a motion hearing for pre trial detention, the defendant was ordered held without bail for a dangerousness hearing on 3/14/14. Must pay legal counsel fee of $150.
