Alan D. Hatch, 43, of Prospect Street, Athol. Charge of assault and battery, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the victim invoked a marital privilege on the record and without her testimony the commonwealth can’t proceed.

Demetri McCassie, 19, of East Howe Street, Orange. Pleaded innocent to assault and battery, released on personal recognizance, continued to 2/21/14 for pretrial conference. Must pay legal counsel fee of $150, or perform 16 hours community service.

Stephen R. Hahn-Barberian, 22, of East Main Street, Orange. Charges of larceny from a person, amended down from unarmed robbery, and aggravated assault and battery with a dangerous weapon, to wit, a shod foot, were not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the victim recanted his version of events as it relates to this defendant. If new evidence becomes available, the commonwealth reserves the right to refile charges.

Pleaded innocent to operating under the influence of liquor, second offense, negligent operation of a motor vehicle, leaving the scene of property damage, marked lane violation, and speeding. in Athol by state police, released on personal recognizance, continued to 3/24/14 for pretrial conference. Must pay legal counsel fee of $150, or perform 16-hours community service.

Jason W. Cordeiro, 36, of Cave Hill Road, Leverett. Found responsible for speeding, in Athol, to be dismissed on payment of $105 fine, forthwith. Charge of negligent operation of a motor vehicle, dismissed prior to arraignment. Found not responsible for failure to stop or yield, and no registration in possession.

Erwin M. Santiago, 49, of Marshall Street, Athol. Charge of negligent operation of a motor vehicle, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the defendant fell asleep at the wheel; the facts in the police report certainly give rise to probable cause for a negligent operation charge. The defendant has proven this should not happen again. No drugs or alcohol were involved.
