Joshua Hurd, 42, of Washington Street, Greenfield. Greenfield, Dec. 18, Judge William Mazanec

Russell H. Lilly, 42, of Ashfield Road, Buckland. Admitted to sufficient facts for operating under the influence of liquor, third offense, sentenced to 2 1/2 years in the house of correction, 180 days direct, recommended it be at the Howard Street Facility in Springfield, balance suspended, placed on probation until 12/17/15, with eight-year loss of license, fined $800, with $200 surfine, head injury assessment of $250, OUI victim’s assessment of $50, and $90 victim witness assessment. Must provide DNA to the state police data base. Must have mental health evaluation according to state law, and take any after care recommended, must have no drugs or alcohol, subject to random testing/screens. Found not responsible for possessing/having an open container of alcohol in a motor vehicle, Charge of negligent operation of a motor vehicle, dismissed at request of the commonwealth. Must pay legal counsel fee of $150, and $150 legal counsel contribution. Must pay $65 per month probation supervision fee.

Damien D. Johnson, 25, of Federal Street, Greenfield. Pleaded innocent to operating with suspended license, subsequence offense, possession of class B drug, to wit, crack cocaine, with intent to distribute, possession of class B drug, to wit, cocaine, possession of a class C drug, to wit, Diazepam, two counts of assault and battery on a police officer, and one charge of failure to wear a seat belt, bail set at $1,000 cash or $10,000 surety, continued to 2/3/14 for pretrial conference. Must pay legal counsel fee of $150, and $50 legal counsel contribution.

Jonathan French, 32, of Sanderson Street, Greenfield. Pleaded innocent to assault and battery, carrying a firearm without a license, improper storage of a large capacity firearm, two charges of possessing a large capacity firearm, one charge of defacing a serial number, one charge of receiving stolen property, and one of possessing a firearm without a firearms identification card, held for a dangerousness hearing, and then ordered held up to 90 days, case continued to 1/16/14 for bind over hearing.

Greenfield, Dec. 19, Judge Laurie MacLeod

Joseph A. Delisle, 28, of Second Street, Turners Falls. Pleaded guilty to violation of an abuse prevention order, in Greenfield, sentenced to two-years in the house of correction, six months direct, balance suspended, placed on probation until 12/18/15, but given credit for time served, must have no drugs or alcohol, subject to random testing/screens, must abide by 209A restraining order. Must have substance abuse evaluation, and take any follow up treatment recommended by probation. Must take and complete the anti-batterer’s program, and abide by the house of correction treatment plan. Pleaded guilty to threatening to commit a crime, to wit, sentenced to six-months direct, concurrent with count one. Pleaded guilty to assault with a dangerous weapon, to wit, a pistol, sentenced to six-months in the house of correction, direct, and concurrent with count one. Must pay $90 victim witness assessment, and must provide DNA to the state police data base. Must pay $65 per month probation supervision fee upon release.

Joseph A. Delisle, 28, of Second Street, Turners Falls. Pleaded guilty to violation of an abuse prevention order, in Greenfield, different date from previous case, sentenced to six months in the house of correction, direct, concurrent with sentence in previous case. Pleaded guilty to assault and battery, and assault with a dangerous weapon, to wit, a pistol, sentenced to the same six-months in the house of correction, and concurrent with count one.

Oliver V. Richards, 23, of Russell Street, Greenfield. Pleaded innocent to assault and battery, bail set at $500 continued to 1/9/14 for pretrial conference.

Dmitriy V. Pyatachenko, 21, of Westfield. Placed on pretrial probation until 12/18/14 for breaking and entering into a building in the daytime with intent to commit a felony, in Deerfield, must stay away from and have no contact with the named victims, and must have substance abuse evaluation, and take any follow up treatment recommended by probation. Must pay $500 restitution to the victims. Placed on pretrial probation until 12/18/14 for larceny from a building, must have no drugs or alcohol, subject to random testing/screens. Must pay legal counsel fee of $150, and $100 legal counsel contribution.

Mathew E. Osowski, 19, of Warner Street, Erving. Charge of being a person under 21 in possession of liquor, to be dismissed on payment of $50 court costs.

Thomas W. Walsh, 34, of Enfield, Conn. Pleaded innocent to possession of Class B drug, to wit, methylenedioxy/methamphetamine, with intent to distribute, in Greenfield, released on personal recognizance, advised of right to a drug examination, continued to 1/27/14 for pretrial conference. Must pay legal counsel fee of $150, and $150 legal counsel contribution.

Jennifer L. Gunnells, 23, of Avenue A, Turners Falls. Pleaded innocent to assault and battery, released on personal recognizance, continued to 1/27/14 for pretrial conference. Must pay legal counsel fee of $150.

Matthew Fisher, 30, of Deerfield Street, Greenfield. Pleaded innocent to assault with a dangerous weapon, to wit, a BB gun, released on personal recognizance, must stay away from and have no contact with the alleged victim, and must have no abuse of the alleged victim, continued to 2/7/13 for pretrial conference. Must pay legal counsel fee of $150.

Matthew Scott Badore, 34, of Pond Street, Greenfield. Pleaded guilty to assault and battery with a dangerous weapon, to wit, a blunt object, a log, in Gill, placed on probation until 6/20/14 with victim witness assessment of $50, and restitution yet to be determined. Must pay legal counsel fee of $150. Must pay $65 per month probation supervision fee.

Matthew Collaro, 24, of Amherst Road, Sunderland. Pleaded innocent to two counts of assault and battery, and one of attempted murder, motion for pretrial detention based on dangerousness was allowed, and then he was released on conditions, of, must have no abuse of the alleged victim, must stay 100 yards away from and have no contact with the alleged victim, must take medications as prescribed, continued to 1/21/14 for bind over hearing. Must pay legal counsel fee of $150.

Kimberly Ann Jones, 25, of Chapman Court, Greenfield. Charge of indecent exposure, to be dismissed on payment of $50 court costs.

Jennifer L. McLain, 32, of Wisdom Way, Greenfield, Pleaded innocent to larceny over $250, conspiracy, and intimidating a witness, juror, police, or court official, bail set at $300 cash or $3,000 surety, and must have no drugs and subject to screens, continued to 2/25/14 for pretrial conference. Cordell Jones, 27, of Burlington, Vt. Pleaded innocent to failure to stop or yield, number plate violation, unlicensed operation of a motor vehicle, using a motor vehicle without authority, second offense, and intimidating a witness, juror, police, or court official, in Greenfield by state police, bail set at $200 cash or $2,000 surety, continued to 2/25/14 for pretrial conference. Darren Chenier, 27, of Winchester, N.H. Found responsible for speeding in violation of special regulations, in Warwick, fined $100. Charge of unlicensed operation of a motor vehicle, dismissed at request of the commonwealth.

Christine A. Dumas, 55, of Chestnut Street, Athol. Pleaded guilty to trespassing, in Orange, fined $80 with $20 surfine, and victim witness assessment of $50. Must pay legal counsel fee of $150.

Justin A. Horne, 22, listed as homeless, of Athol. Found responsible for larceny under $250, fined $100. Charges of possession of a burglarious instrument, and malicious destruction of property over $250 value, both dismissed at request of the commonwealth. Must pay legal counsel fee of $150.

Shelly Blanchette, 38, of Green Street, Athol. Pleaded innocent to unregistered motor vehicle, uninsured motor vehicle, number plate violation to conceal identification, and operating with suspended license, released on personal recognizance, continued to 3/3/14 for pretrial conference.

cJason L. Ruuska, 42, of Gardner. Pleaded innocent to receiving stolen property, operating with suspended license, number plate violation to conceal identification, and unregistered motor vehicle, in Orange, released on personal recognizance, continued to 1/24/14 for pretrial conference.

Andrew J. Bezio, 25, of Lake Street, Athol. Pleaded innocent to no registration in possession, and operating with suspended license, released on personal recognizance, continued to 1/31/14 for pretrial conference.

Alison M. Knibbs, 33, of Warren. Pleaded innocent to larceny over $250, from Walmart in Orange, bail set at $200 by agreement, continued to 2/7/14 for pretrial conference. Must pay legal counsel fee of $150, or perform 16 hours community service.

Weldon C. Yarborough, 40, of Montague City Road, Greenfield. Charge of assault and battery, in Erving, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the victim has asserted her Fifth Amendment right and the commonwealth can’t prove its case without this witness. Must pay legal counsel fee of $150, or perform 16 hours community service.

Evelyn M. Rivera, 28, of East Prospect street, Erving. Charge of assault and battery, was not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the victim has asserted his Fifth Amendment right and the commonwealth can’t prove it case without this witness. Must pay legal counsel fee of $150, or perform 16 hours community service.

Nathan R. Hubbard, 32, of New Street, Millers Falls. Charge of operating with suspended license, in Erving by state police, to be dismissed on payment of $25 court costs.

Nathan M. Ortiz, 29, of Beech Street, Greenfield. Pleaded innocent to five charges of violation of an abuse prevention order, bail set at $100 cash and must abide by 209A restraining order in effect, continued to 1/8/14 for pretrial conference.
