Former Greenfield doctor again faces tax charges

GREENFIELD — Richard C. McGinn, a former doctor in Greenfield, is again facing federal tax charges.

An indictment charges McGinn, 66, with 10 counts of tax crimes adding up to a potential 34 years in prison, 22 years of supervised release and a $250,000 fine.

McGinn, who is not currently licensed to practice in the state, faced similar charges in the mid-1990s.

The U.S. Attorney’s office alleges McGinn evaded taxes for numerous years between 1987 and 2003, failed to pay over and account for employment taxes that he withheld from his employees during 2008 and 2009 and failed to file tax returns for his medical practice from 2006 to 2009.

This is not McGinn’s first run-in with tax law and the period of the alleged tax evasion covers tax crimes he previously admitted to.

In 1996, McGinn pleaded guilty in U.S. District Court to attempting to evade his 1991 taxes and was sentenced to 15 months in prison.

McGinn incorporated his practice, Franklin Health Care Associates, in 2004, leasing office space from the former Franklin Medical Center beginning in 2003.

FMC sued McGinn for back rent in 2006 after he moved the office to the second floor of 25-27 Bank Row.

The court decided in favor of FMC in 2007, ordering McGinn to pay $40,201.39 in damages, interest, fees and expenses according to court records.

Franklin Health Care Associates was dissolved as a corporation in June according to records filed with the Secretary of the Commonwealth, and the Bank Row address no longer lists the practice among its professional offices.

According to the offices of the Massachusetts Board of Registration in Medicine, McGinn’s general practice and obstetrics/gynecology license was allowed to expire Sept. 16, 2011.

McGinn’s office phone number has been disconnected and his home phone is not listed. McGinn was listed as a resident of 119 High St. in the 2011 Greenfield street listing.
