CONWAY — The owners of 1615 Main Poland Road have until June 2 to vacate their trailer home on the quiet country road before the town boards up and secures the property for failure to repair a septic system.

At a condemnation hearing on Monday, the Board of Health told Gene Malloy to leave his home.

After a home is condemned, the homeowner is not allowed to live there until repairs are made — in this case to the failed septic system. The homeowner still owns the property and pays taxes. If no work is done in one year, the town can move to demolish the dwelling.

Angry and frustrated, Malloy said he will put a for-sale sign on the home.

Sitting on the bank of Chapel Brook, Malloy’s front yard is littered with junk.

The property has become a neighborhood nuisance as many neighbors complained to the town about the home’s condition and safety and environmental hazards it may pose.

For three years, the town has worked with Malloy to fix his house, but the health board said no improvement has been made.

In 2010, the Board of Health conducted sanitary code inspections on the property. The house also had a Title 5 inspection for a failed septic system. According to state law, a homeowner has two years to repair a septic system after a failed Title 5 inspection.

Later in March 2013, the Board of Health again asked in a letter for Malloy to clean the property.

On April 25 this year, the state Department of Public Health inspected the property and found several state sanitary code violations.

Malloy was given until June 1 to remove tires, putrid trash, plastic barrels, tarps and oil cans. The state also found that Malloy’s practice of dumping near the brook is impacting the Chapel Brook.

At the hearing, Malloy said he had tried to do everything he could. He said he had contacted the Franklin County Regional Housing and Redevelopment Authority for help.

Board of Health member Gina McNeely told Malloy the housing authority did not receive paperwork from Malloy.

“There has been no money allocated to repair the septic. There was no paperwork delivered by you,” McNeely said.
