Orange man arrested on child porn, gun charges

ORANGE — A 46-year-old local man faces child pornography and firearms charges.

David E. Johnstone of 54 Ward Road was arrested Wednesday evening as state and local police executed a search warrant at his home. He is set to be arraigned today in Orange District Court.

At Johnstone’s house, police found more than six gigabytes of child pornography and six loaded, unsecured firearms, according to a news release from the Northwestern District Attorney’s Office.

Police also confiscated an SKS assault rifle, a Smith and Wesson .357-caliber handgun and a Duo .25-caliber pistol, none of which Johnstone was licensed to own, according to the release.

Johnstone’s charges include dissemination of child pornography, possession of child pornography, three counts of unlawful possession of a loaded firearm, three counts of improper storage of firearms, and possession of ammunition without an FID.

Johnstone was held on $10,000 cash bail after his arrest, though the amount could change at his arraignment.

Johnstone has prior firearms convictions.

In 2007, Johnstone was arrested when police found more than two dozen illegally owned firearms in his house. They included a 9mm submachine gun, 13 handguns, 15 rifles, 68 magazines and 11,000 rounds of ammunition.

Officers had searched his house with his wife’s permission after he gave her a 16-page suicide note and loaded a single bullet into one of his handguns on Dec. 17, 2007. He was initially charged with four counts of possession of a large capacity firearm, unlawful possession of a firearm, improper storage of a large capacity firearm and illegal possession of ammunition.

On New Year’s Eve 2009, Johnstone pleaded guilty to reduced charges as part of a plea bargain, including illegal possession of a firearm, improper storage of a small capacity firearm, and unlawful possession of ammunition, in Franklin Superior Court.

He was sentenced by Judge John Agostini to one year in the county jail, followed by a single year of probation. The weapons were seized and slated for demolition.
