Damien D. Charge of possession of Class B drug, to wit, crack cocaine with intent to distribute, dismissed at request of the commonwealth. Pleaded guilty to possession of Class B drug, to wit, cocaine, possession of a Class C drug, to wit, Diazepam, and two counts of assault and battery on two police officers, sentenced to one year in the house of correction, direct, on each plea, concurrent with count one. Admitted to sufficient facts for possession of Class B drug, to wit, Percocet, but continued without a finding until 8/28/14. Must pay legal counsel fee of $150. Robert J. Bennan, 27, of Spring Street, Athol. Charge of operating with suspended registration, in Gill by state police, to be dismissed on payment of $50 court costs, and it was paid. Greenfield, March 3, Judge William Mazanec

Christopher McCracken, 26, listed as homeless, of Greenfield. Pleaded innocent to assault and battery, intimidating a witness, juror, police, or court official, and attempted murder, in Sunderland, ordered held for dangerousness hearing on 3/10/14.

Mark M. Holland, 63, of Turnpike Road, Turners Falls. Admitted to sufficient facts for threatening to commit a crime, to wit, murder, but continued without a finding until 9/3/14 with victim witness assessment of $50, must have no abuse of the victim, must have no drugs or alcohol, subject to random testing/screens, and forfeiture of seized items. Charges of assault with a dangerous weapon, to wit, a handgun, carrying a dangerous weapon, to wit, a handgun, disorderly conduct, possession of a firearm without a firearms identification card, carrying a firearm without a license, improper storage of a large capacity firearm, and two charges of possessing a large capacity firearm, were not prosecuted, as, according to a written statement from a counsel on the district attorney’s staff, the items at issue do not appear to be functioning firearms which negates most of the charges; as to count three, the disorderly conduct issue occurred inside the defendants residence. Must pay $50 per month probation supervision fee.

Pleaded guilty to operating under the influence of liquor, second offense, placed on probation until 3/4/16, plus head injury assessment of $250, OUI victim’s assessment of $50, and victim witness assessment of $50. Must take and complete the 14 day inpatient drug and alcohol education program, and pay the fee of $1050. And must continue with mental health counseling, and must have substance abuse evaluation, and take any follow up treatment recommended by probation. Andrew Marciano, 27, of North Hatfield.
