Greenfield, Sept. 12, Judge William Mazanec III

Tommie P. Kendrick III, 29, of Oak Courts, Greenfield. Placed on pretrial probation until 12/12/17 for inhaling glue/toxic substance.

Cameron T. Schmuck, 26, of Wilbraham. Admitted to sufficient facts for negligent operation of a motor vehicle in Bernardston by state police. Sufficient facts found, but continued without a finding until 3/12/18, must take and complete the safe driver education program, and must have no criminal driving charges. Found not responsible for marked lanes violation, for having an open container of marijuana in a vehicle, and speeding. Must pay $50 per month probation supervision fee.

Ross B. Finch, 42, of Montague Road, Sunderland. Pleaded innocent to assault and battery on family/household member. Released on personal recognizance. Must have no alcohol and subject to screens and testing. Must have a Scram unit applied, but must report daily to the probation office until the Scram unit can be applied, and must abide by any 209A restraining order in existence. A C276, section 56A form was filed by the Commonwealth, and an allegation of abuse under 276, section 56A, was found. Continued to 10/21/17 for pretrial conference.

Christopher S. Clayton, 27, of South Street, Athol. Pleaded guilty to possessing a Class A drug, to wit, heroin, subsequent offense. Placed on probation until 3/11/19, with must have no drugs, and subject to screens. Must have mental health evaluation and take any
after-care recommended, and the same for a substance abuse evaluation, and take any follow up recommended, and must enroll and complete the program at Orange Drug Court. Found not responsible for no inspection sticker. Charge of operating a motor vehicle with license suspended, subsequent offense, dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month.

Stephen M. Emerson, 30, of Haywood Street, Greenfield. Pleaded innocent to operating under the influence of liquor or 0.08 percent, speeding, possessing a Class B drug, to wit, white powdery substance, and operating a motor vehicle in violation of a license restriction. Released on personal recognizance. Continued to 10/26/17 for pretrial conference. Must pay legal counsel fee of $150.

Amanda M. Fogg, 30, of West Townsend, Vt. Pleaded innocent to possessing a Class B drug, to wit, buprenorphine, possessing a Class C drug, to wit, clonazpam, possessing a Class E drug, to wit, xanax, being a vehicle operator refusing to identify him or herself, unlicensed operation of a motor vehicle, and intimidating a witness, juror, police, or court official in Whately by state police. Released on personal recognizance. Continued to 10/31/17 for pretrial conference.

Orange, Sept. 12, Judge David S. Ross

Edward B. Doucette, 30, of West Main Street, Orange. Pleaded guilty to assault and battery. Placed on probation until 3/12/18, and must have no drugs or alcohol and subject to screens/tests. Restitution yet to be determined. Admitted to sufficient facts for assault and battery on family/household member. Sufficient facts found but continued without a finding until 3/12/18 with victim-witness assessment of $90. Must pay counsel fee of $150, or perform 16 hours of community service. Must Pay $50 default warrant fee. Must pay $25 per month probation supervision fee.

Sommer H. Cortes, 19, of Pray Drive, Greenfield. Admitted to sufficient facts for assault and battery, placed on probation until 9/12/18 with victim-witness assessment of $50, and must take and complete a substance abuse evaluation, and take any after-care treatment recommended, and must also have mental health evaluation and take any after-care recommended. Must have no drugs or alcohol, and subject to screens. Charges of armed burglary in an assault, vandalizing property, assault and battery with a dangerous weapon, to wit, a shod foot, intimidating a witness, juror, police, or court official, threatening to commit a crime, to wit, murder and assault and battery with a dangerous weapon, to wit, a shelf, on a person who was under 14 and the defendant was 17 or older, all dismissed on request of the Commonwealth. Must pay counsel fee of $150, or perform 16 hours of community service. Must pay $50 per month probation supervision fee.

Troy H. Mackey, 46, of Eastern Avenue, Greenfield. Placed on pretrial probation until 3/12/18 for operating under the influence of liquor or 0.08 percent, and must have no drugs or alcohol, and subject to screens/tests.

Michael Hayes, 37, of Main Street, Shelburne Falls. Admitted to sufficient facts for negligent operation of a motor vehicle, in Greenfield, but continued without a finding until 9/11/18, with head-injury assessment of $250, and victim-witness assessment of $50, must continue all VA programming, and must sign releases so that the probation office can monitor attendance at programs ordered by the judge. Must pay $50 per month probation supervision fee.

Dale J. Descavich, 60, of Turners Falls Road. Greenfield. Placed on pretrial probation until 12/12/17 for assault and battery, and must stay away from and have no contact with a named person.

Gary G. Conaway, 36, of Riverview Drive, Northfield. Admitted to sufficient facts for assault and battery on family/household member, but continued without a finding until 3/12/19, with victim-witness assessment of $50, and must have mental health evaluation and take any after-care recommended, must have no abuse of the victim, and must attend and complete the batterer’s program. Sufficient facts found for malicious destruction of property under $250 value, amended down from malicious destruction of property over $250 value, but continued without a finding until 3/12/19. Charge of animal cruelty dismissed on request of the Commonwealth. Must pay probation supervision fee of $65 per month.

Jonathan Mathieu, 31, of Fourth Street, Turners Falls. Found responsible for unlicensed operation of a motor vehicle, in Greenfield. Filed with defendant’s consent, and decriminalized, to wit, converted to a civil offense. Found not responsible for number plate violation.

Jonathan Mathieu, 31, of L Street, Turners Falls. Admitted to sufficient facts for assault and battery on family/household member, different date from previous cases. Sentenced to 99 days in the house of correction, and was given credit for 99 days held. Charges of strangulation or suffocation, and intimidating a witness, juror, police, or court official, both dismissed on request of the Commonwealth.

Tiffani R. Martin, 22, of Palmer. Charge of operating a motor vehicle with license suspended in Montague by state police. To be dismissed on payment of $50 court costs, and it was paid. Found guilty of possessing a Class A drug, to wit, heroin, filed with defendant’s consent until 3/13/18.

William G. LaFrennie, 27, of Elm Street, Franklin County House of Correction, Greenfield. Charge of being a fugitive from justice on a court warrant from New Hampshire was not prosecuted, as according to a statement made by a counsel from the district attorney’s office, the defendant has cleared his out-of-state warrant, and is therefore no longer a fugitive from justice.
