Orange, May 4, Judge David S. Ross

Krysty L. Walsh, 31, of Daniel Shays Highway, Orange. Pleaded guilty to possessing a Class B drug, to wit, methadone, sentenced to 90 days in the house of correction, direct, and given credit for time held. Charge of possessing a Class E drug, to wit, Gabapentin dismissed on request of the commonwealth. Must pay counsel fee of $150, or perform 12 hours of community service, in lieu of regular 16 hours.

Greenfield, May 9, Judge Patrick Sabbs

Luis Pagan, 40, of Bayberry Court, Greenfield. Pleaded innocent to violation of an abuse prevention order. Ordered held for up to 120 days for dangerousness. Continued to 6/5/18 for pretrial conference.

Luis Pagan, 40, of Bayberry Court, Greenfield. Pleaded innocent to violation of an abuse prevention order, vandalizing property, trespassing, stalking in violation of restraining order, breaking and entering with intent to commit a misdemeanor, assault and battery in violation of an abuse prevention order, threatening to commit a crime, to wit, assault and battery and intimidating a witness, juror, police, or court official, different date from previous case. Ordered held for up to 120 days for dangerousness. Continued to 6/5/18 for pretrial conference.

Justin T. Hoehn, 39, of Greenfield Road, Deerfield. Pleaded innocent to violation of an abuse prevention order, and possessing a Class B drug, to wit, adderall, in Greenfield. Released on personal recognizance. Must comply with the GPS program. Must abide by any 209A restraining order in existence and must have no contact with a named person. Continued to 6/5/18 for pretrial conference. Must pay legal counsel fee of $150, with $350 counsel contribution.

Fernando A. Ortiz-Medina, 55, of Holyoke. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent in Greenfield. Sufficient facts found, but continued without a finding until 5/9/19, with 45-day mandatory loss of license, head-injury assessment of $250, and OUI victims assessment of $50. Must take and complete the driver alcohol education program, but the fee of $726.80 is waived in this case. Charge of negligent operation of a motor vehicle dismissed on request of the commonwealth. Found not responsible for marked lanes violation, rate of speed exceeding the posted limit, no inspection sticker, unregistered motor vehicle and possessing an open container of alcohol in a motor vehicle.

Lloyd W. Ellis, 20, of Colrain Shelburne Road, Shelburne. Admitted to sufficient facts for reckless operation of a motor vehicle in Buckland by state police. Sufficient facts found, but continued without a finding until 5/9/19, plus victim-witness assessment of $50. Must have mental health evaluation and take any after-care as directed. Must attend and complete the certified batterer’s program. Must stay away from and have no contact with two named people and stay away from a specified Ashfield residence. Found responsible for speeding in violation of special regulation. Fined $100. Found responsible for passing violation. Fined $100. Found not responsible for violation of state highway traffic regulations, violation of state highway signals, signs or markings and marked lanes violation. Must pay probation supervision fee of $65 per month.

Charge of being the owner of, or the person in control of, a motor vehicle, did knowingly permit such vehicle to be operated by a person who was unlicensed or whose license had been suspended or revoked dismissed on request of the commonwealth.

Yamil Galarza-Perez, 43, of Oak Courts, Greenfield. Found responsible for unlicensed operation of a motor vehicle. Fined $100, and decriminalized, to wit, converted to a civil offense. Found not responsible for failure to stop/yield.

Karri L. Bailey, 32, of Chapman Street, Greenfield. Operating a motor vehicle with license suspended, subsequent offense. Released on personal recognizance. Continued to 8/10/18 for pretrial conference.

Sufficient facts found, but continued without a finding until 5/10/19, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program and pay the fee of $726.80.

Peter L. Bryant, 27, of Main Road, Monroe. Admitted to sufficient facts for larceny over $250. Sufficient facts found, but continued without a finding until 11/9/18. Must pay $2,790 restitution to Nouria Energy Corp., at the rate of $100 per month, at minimum. Must continue with the current treatment, and must sign releases so that the probation office can monitor attendance at programs ordered by the judge. Admitted to sufficient facts for breaking into a depository. Sufficient facts found, but continued without a finding until 11/9/18, with same conditions as in count one.

Matthew G. Hansen, 31, of Daniel Shays Highway, Orange. Pleaded innocent to attempting to commit a crime, to wit, murder, assault and battery with a dangerous weapon, to wit, a knife, resisting arrest, assault and battery on a police officer, mistreating/interfering a police horse/dog, and two charges of assault and battery. Ordered held by agreement for a dangerousness hearing on 6/1/18.

Stephen J. Hosier, 31, of Central Street, Turners Falls. Pleaded innocent to assault and battery with a dangerous weapon, to wit, a silver/black folding knife, and assault with a dangerous weapon, to wit, a folding knife. Raven S. Sullivan, 21, of Springfield. Pleaded innocent to trafficking in 0.36 grams or more, or less than 100 grams of cocaine, conspiracy to violate drug laws, possessing an open container of alcohol in a motor vehicle, and failure to wear a seat belt in Greenfield by state police. Released on personal recognizance. Must remain at the Wayfinder residential facility in Indian Orchard and must obey the requirements at the Wayfinder. Must have no drugs and be subject to screens. Continued to 6/12/18 for bind-over hearing.

Ashlee A. Fountan, 24, of Bayberry Court, Greenfield. Charges of operating a motor vehicle with suspended registration and uninsured motor vehicle both dismissed on request of the commonwealth.

Christopher W. Hathaway, 34, of Westford. Charges of failure to stop for police, negligent operation of a motor vehicle, disorderly conduct, motor vehicle lights violation and resisting arrest in Deerfield were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the defendant is currently receiving significant mental health treatment; given the facts of this case and the treatment he is currently receiving, this is in the best interests of justice.

Pleaded innocent to breaking and entering a building in the nighttime with intent to commit a felony, resisting arrest, vandalizing property and larceny under $250. Bail set at $1,000 cash or $10,000 surety. Continued to 6/4/18 for pretrial conference.

Hilary A. Henderson, 33, of Northfield Road, Bernardston. Pleaded guilty to possessing a Class A drug, to wit, heroin, sentenced to 30 days in the house of correction, direct, with credit for time served. Probation terminated on recommendation of the probation department. Charge of operating a motor vehicle with license suspended dismissed on request of the commonwealth.
