Greenfield, Dec. 15, Judge William Mazanec III

Domingo Banks-Burgos, 38, of Colrain Street, Greenfield. Pleaded innocent to assault and battery on family/household member, strangulation or suffocation, and larceny under $250, and unarmed robbery, and on 12/19/17 a dangerousness hearing was held, and on the charge of unarmed robbery was not prosecuted as, according to a statement made by a counsel from the district attorney’s office, from the victim’s testimony during the 58A (dangerousness) hearing, it appears the larceny occurred after the assault and battery, and was not the motivation for the assault; therefore, we would not be able to sustain this charge. The other charges will be heard on 1/11/18 in a pretrial hearing.

Greenfield, Dec. 18, Judge Michael Ripps

Jessica L. Ramirez, 29, of Brattle Street, Orange. Pleaded innocent to larceny by check over $250, and uttering a false check in Northfield. Released on personal recognizance. Must have no drugs, and subject to screens. Continued to 2/7/18 for pretrial conference.

Chad W. Oberacker, Pleaded innocent to assault and battery, assault to murder, assault and battery with a dangerous weapon, to wit, scissors, assault with a dangerous weapon, to wit, a motor vehicle, reckless operation of a motor vehicle, and failure to stop for police in Gill by state police. Ordered held on dangerousness, and continued to 1/8/18 for a hearing.

Orange, Dec. 18, Judge David S. Ross

Solimar Perez, 30, of Montague Road, Leverett. Charge of unregistered motor vehicle, dismissed on request of the Commonwealth. Found not responsible for uninsured motor vehicle.

Matthew L. Oalmeiri, 27, of North Adams. Charge of unlicensed operation of a motor vehicle, in Erving, dismissed on request of the Commonwealth. Found not responsible for unregistered motor vehicle,

James L. Horsley III, 24, of Greenville, N.H. Placed on pretrial probation until 3/16/18 for negligent operation of a motor vehicle in Erving. Charge of unlicensed operation of a motor vehicle dismissed on request of the Commonwealth. Found not responsible for rate of speed exceeding the posted limit. Must pay $50 per month probation supervision fee.

Adam Lane, 33, of Central Street, Turners Falls. Charges of operating with suspended registration, and uninsured motor vehicle, in Erving, both dismissed on request of the Commonwealth. Found not responsible for no inspection sticker.

Mikayla D. Anglada, 19, of Manchester, N.H. Pleaded innocent to vandalizing property, assault and battery, and of threatening to commit a crime, to wit, murder. Released on personal recognizance. Continued to 2/12/18 for pretrial conference. Must pay counsel fee of $150, or perform 12 hours of community service, in lieu of regular 16 hours.

Taylor Gardner, 26, of Holtshire Road, Orange. Pleaded innocent to operating a motor vehicle with license suspended, and rate of speeding exceeding the posted limit. Released on personal recognizance. Continued to 2/16/18 for pretrial conference.

Jamie Muniz Jr., 34, of South Main Street, Orange. Pleaded innocent to operating under the influence of liquor or 0.08 percent, negligent operation of a motor vehicle, and failure to stop/yield in Erving. Released on personal recognizance. Continued to 2/12/18 for pretrial conference. Must pay legal counsel fee of $150.

Jason W. Salls, 39, of School Street, Athol. Placed on pretrial probation until 6/18/18, for shoplifting, at Wal-Mart in Orange.

Greenfield, Dec. 19, Judge William Mazanec III

Carla Day Taft, 70, of Amherst Road, Sunderland. Charge of operating under the influence of liquor or 0.08 percent. The defendant was found not guilty by a jury trial.

Donald F. Hill, 49, of West Street, Montague. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent, second offense, amended down from third offense. Sufficient facts found, but continued without a finding until 12/18/19, with two-year loss of license, but must have no driving until the Registry of Motor Vehicles reinstates the license, $500 fine, plus $100 surfine, head-injury assessment of $250, OUI victims assessment of $50, and victim-witness assessment of $50. Must take and complete a 14-day inpatient counseling, and take any after-care recommended. Found not responsible for marked lanes violation, Charge of negligent operation of a motor vehicle, dismissed on request of the Commonwealth. Must pay probation supervision fee of $65 per month.

Orange, Dec. 19, Judge David S. Ross

Ashley Egger, 28, of Mechanic Street, Orange. Pleaded innocent to larceny of a drug, amended to larceny under $250, and assault and battery. Released on personal recognizance. Continued to 2/16/18 for pretrial conference. Must pay counsel fee of $150, or perform 12 hours of community service, in lieu of regular 16 hours.

Terrance L. Shufelt Jr., 41, of South Athol Road, Athol. Pleaded innocent to being the owner of, or the person in control of, a motor vehicle, did knowingly permit such vehicle to be operated by a person who was unlicensed or whose license had been suspended or revoked. Released on personal recognizance. Continued to 2/16/18 for pretrial conference. Must pay counsel fee of $150, or perform 12 hours of community service, in lieu of regular 16 hours.

Matthew A. Gibson, 28, of Winthrop Street, Athol. Admitted to sufficient facts for assault with a dangerous weapon, to wit, a semi-automatic pistol, S&W, M&P, 9mm. Sufficient facts found, but continued without a finding until 12/17/19. Must complete anger management program and must forfeit the license fire arms, and must possess no firearms, and must have no contact with the victims. Second charge of assault with a dangerous weapon, to wit, the same semi-automatic pistol, and as in the previous count, and four charges of reckless endangerment of a child were all dismissed on request of the Commonwealth. Must pay $50 per month probation supervision fee.

Veronica L. Ocasio, 20, of Sanders Street, Athol. Placed on pretrial probation until 6/19/18, for assault and battery on family/household member, and must pay $100 restitution by 2/28/18. Placed on pretrial probation until 6/19/18 for wanton destruction of property under $250. Must pay counsel fee of $150, or perform 16 hours of community service. Must pay $10 Probation Supervision Fee for January and February only.
