Pleaded guilty to operating under the influence of liquor or 0.08 percent, placed on probation until 11/5/19 with 90 days loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must have no drugs or alcohol, and subject to screens/tests, and must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Edward Smith, 26, of Amherst Road, Sunderland. Charge of operating under the influence of liquor or 0.08 percent, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after carefully reviewing the facts of this case, along with the evidence we could produce at trial, this action is in the best interests of justice. Found responsible for motor vehicle lights violation. Fined $35.

Scott Malek, 35, of Congress Street, Greenfield. Pleaded guilty to operating under the influence of liquor or 0.08 percent, with two-year loss of license. Placed on probation until 11/5/19, with head-injury assessment of $250, OUI victims assessment of $50, and victim-witness assessment of $50. Must take the 14-day inpatient program and take any after-care recommended. Must have no drugs or alcohol, and subject to screens/tests. Must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Pleaded guilty to carrying a firearm without a license and must forfeit/surrender all firearms. Must possess no firearms during probation, and same conditions as in count one. Pleaded guilty to possessing a Class C drug, to wit, Clonopin, placed on probation until 11/5/19 with same conditions as in count one. Pleaded guilty to second charge of carrying a firearm without a license, with same conditions as in count one and with the same added conditions of forfeit items for destruction and must surrender all firearms and possess no firearm during the probation. Two charges of carrying a dangerous weapon, to wit, a knife/cutting instrument, on both charges, and both were dismissed on request of the Commonwealth. Found not responsible for possessing an open container of alcohol in a motor vehicle. Must pay legal counsel fee of $150 and $50 counsel contribution. Must pay probation supervision fee of $65 per month.

Scott Malek, 35, of Congress Street, Greenfield. Pleaded guilty to possessing a Class B drug, to wit, suboxone, same date as in previous case, but the offense was brought fourth by a member of the public, and must have no drugs or alcohol, and subject to screens, and must take and complete substance abuse evaluation, and take any after-care treatment recommended.
