Hubert Spencer, 20, of Brooklyn, N.Y. Pleaded innocent to trafficking in more than 10 grams of Fentanyl, and conspiracy to violate drug laws in Greenfield by state police. Bail set at $30,000 cash or $300,000 surety. Continued to 7/9/19 for bind-over hearing.

Orange, June 5, Judge David S. Ross

Anthony J. Doughty, 41, of North Main Street, Orange. Pleaded guilty to operating a motor vehicle with license suspended, and shoplifting, at Walmart, and must perform four hours of community service, by 7/3/18, for both. Charge of negligent operation of a motor vehicle. Sufficient facts found, but continued without a finding until 9/4/18, with head-injury assessment of $250. Pleaded guilty to failure to stop for police, and must perform eight-hours community service by 7/3/18. Must pay counsel fee of $150, or perform 12 hours of community service, in lieu of regular 16 hours.

Gavin L. Munoz, 25, of Cottage Street, Orange. Charge of number plate violation to conceal identification to be dismissed on payment of $200 court costs. Found not responsible for unregistered motor vehicle,

Andrew K. Schibner, 33, of Lenoir City, Tenn. Charge of unlicensed operation of a motor vehicle in Erving dismissed on request of the commonwealth. Found not responsible for no inspection sticker.

Devin M. O’Brien, 26, of Perry Road, Orange. Pleaded innocent to assault and battery on family/household member, and kidnapping. Released on personal recognizance. Continued to 7/20/18 for pretrial conference. Must pay legal counsel fee of $150.

Greenfield, June 6, Judge William Mazanec III

Rabecka Mitchell, 38, of Eastern Avenue, Greenfield. Admitted to sufficient facts for possessing a Class B drug, to wit, cocaine. Sufficient facts found, but continued without a finding until 12/6/18 with victim-witness assessment of $50. Must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Admitted to sufficient facts, for possessing a Class E drug, to wit, unidentified pills. Sufficient facts found, but continued without a finding until 12/6/18, with same conditions as in previous count. Charge of operating under the influence of liquor or 0.08 percent was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after reviewing all evidence that would be admitted at trial, the commonwealth can’t sustain its burden as it relates to this charge. Must pay $50 per month probation supervision fee.

John J. Mossman III, 51, of Russell Street, Sunderland. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent in Deerfield. Sufficient facts found, but continued without a finding until 6/5/19, with 45-day mandatory loss of license, with travel restoration stricken for work purposes, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $726.80. Charge of negligent operation of a motor vehicle dismissed on request of the commonwealth. Found not responsible for failure to drive in the right lane. Must pay probation supervision fee of $65 per month.

Joshua L. Hall, 21, of River Street, Colrain. Pleaded innocent to operating under the influence of liquor or 0.08 percent. Released on personal recognizance. Continued to 8/3/18 for pretrial conference.

Christopher P. Payette, 48, of Hayes Avenue Greenfield. Charge of possessing a Class B drug, to wit, cocaine, with intent to distribute, amended down from distributing the Class B drug, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the commonwealth states that further prosecution isn’t in the interest of justice. Must perform 16 hours community service in lieu of legal counsel fee.

Jamie S. Matosky, 24, of Upper Farms Road, Northfield. Charge of violation of an abuse prevention order, in Montague, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the commonwealth can’t sustain its burden at trial with the evidence available on this matter.

Courtney E. Brown, 24, of Chapman Street, Greenfield. Charge of larceny over $250 was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the commonwealth states that a key witness was recently accused by Dollar General. Officer sent, stealing deposits in almost the exact same manner as this defendant. Although those allegations are still under investigation, they cast serious doubt on this defendant’s guilt, and so state can’t in good faith proceed with prosecuting this case at this time. Must pay legal counsel fee of $150 and $50 counsel contribution.

Jody Thurber, 42, of Deerfield Street, Greenfield. Admitted to sufficient facts for assault and battery on a police officer. Sufficient facts found, but continued without a finding until 12/6/18, plus must have no alcohol and subject to screens. Must comply with the Scram program. Must sign releases so that the probation office can monitor attendance at programs ordered by the judge, must have mental health evaluation and take any after care recommended, and must stay 50 feet away from and have no contact with the victims. Admitted to sufficient facts for resisting arrest. Sufficient facts found, but continued without a finding until 12/6/18 with all the same conditions as in previous count. Two charges of assault and battery on family/household member both dismissed on request of the commonwealth. Must pay legal counsel fee of $150.

Nolan H. Courtemanche, 19, of Dell Street, Turners Falls. Placed on pretrial probation until 6/6/19, for larceny under $250 in Greenfield, but may be dismissed on condition that the $175 restitution, due to the Vispassana Meditation Center in Shelburne, is paid.

James R. Bennett, 37, of Springfield. Charge of operating a motor vehicle license suspended in Deerfield by state police amended down from operating a motor vehicle with license suspended for operating under the influence of liquor to be dismissed on payment of $50 court costs. Found not responsible for failure to drive in the right lane, and speeding. Must pay legal counsel fee of $150.

James E. Yuille, 28, of East Hampton, Conn. Pleaded guilty to possessing a Class D drug, to wit, marijuana with intent to distribute in Deerfield by state police. Fined $500, plus $250 surfine, to be paid by 9/7/18. Charge of possessing a Class C drug, to wit, 36 bottles of THC oil dismissed on request of the commonwealth. Must pay legal counsel fee of $150.

Mary Rapier, 57, of Chapman Street, Greenfield. Placed on pretrial probation until 12/7/18 for assault and battery on family/household member and must continue weekly counseling with CSO. Placed on pretrial probation until 12/7/18 for intimidating a witness, juror, police or court official and given the same conditions in previous count. Must pay legal counsel fee of $150.

James O. Sanchez, 26, of Walnut Street, Athol. Pleaded guilty to operating a motor vehicle with license suspended, subsequent offense, in Gill. Placed on probation until 12/7/18. Found not responsible for unregistered motor vehicle, and no inspection sticker. Must perform 16 hours community service in lieu of legal counsel fee.

Marie Labier, 72, of Springfield. Placed on pretrial probation until 6/6/19 for negligent operation of a motor vehicle in Deerfield by state police and must not drive until the Registry of Motor Vehicles reinstates the license. Found responsible for marked lanes violation, filed, with defendant’s consent, for 30 days.

Jose J. Garcia, 20, of Bronx, N.Y. Admitted to sufficient facts for possessing a Class A drug, to wit, heroin with intent to distribute, amended down from trafficking in 0.36 grams or more, or less than 100 grams of heroin/morphine/opium. Sufficient facts found, with victim-witness assessment of $50, and placed on probation until 6/6/19. Conspiracy to violate drug laws dismissed on request of the commonwealth. Must pay legal counsel fee of $150. Must pay $50 per month probation supervision fee.

Brandon L. Sayer, 38, of West Street, Greenfield. Found responsible for operating a motor vehicle with license suspended. Fined $50. Found not responsible for motor vehicle lights violation.

Richard A. Arabia, 47, of Cross Street, Buckland. Admitted to sufficient facts for negligent operation of a motor vehicle in Greenfield. Sufficient facts found, but continued without a finding until 6/6/19, with victim-witness assessment of $50. Must take and complete the eight-hour safe driver education program. Must stay 100 yards away from and have no contact with a victim, except as allowed and ordered by the Franklin Probate and Family Court, and must abide by any 209A restraining order in existence. Found not responsible for no inspection sticker, and rate of speeding exceeding the posted limit, Must pay probation supervision fee of $65 per month.

Richard A. Arabia, 47, of Cross Street, Buckland. Pleaded guilty to violation of an abuse prevention order, in Greenfield, different date from previous case. Sentenced to six months in the house of correction, suspended. Placed on probation until 6/6/19 with same conditions as in previous case. Must pay legal counsel fee of $150.

Must have no abuse of the victim, and must report to probation for testing. Placed on probation until 6/5/20, with two-year loss of license, and must not drive until the Registry of Motor Vehicles reinstates the license. Must have no drugs or alcohol, and subject to screens. Must take and complete the drug court program, and must comply with that program’s directions. Charges of operating a motor vehicle with license suspended, and negligent operation of a motor vehicle both dismissed on request of the commonwealth. Found not responsible for possessing an open container of alcohol in a motor vehicle and failure to drive in the right lane. Must pay probation supervision fee of $65 per month.

Christopher J. Sagan, 39, of Captain Lathrop Drive, South Deerfield. Pleaded guilty to operating under the influence of liquor or 0.08 percent, second offense, different date from previous case. Placed on probation until 6/5/20, with victim-witness assessment of $250, victim-witness assessment of $50 and OUI victims assessment of $50, and with same conditions, and concurrent with, the previous case. Charge of possessing a Class B drug, to wit, cocaine dismissed on request of the commonwealth. Admitted to sufficient facts for malicious destruction of property under $1,200 value, must pay $369.66 restitution to a Deerfield resident, and is concurrent with count one. Found not responsible for charge of possessing an open container of alcohol in a motor vehicle.

Domingo Banks-Burgos, 37, of Colrain Street, Greenfield. Charges of assault and battery on family/household member, strangulation or suffocation, unarmed robbery and larceny under $250, were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the defendant has been indicted and arraigned in Franklin Superior Court.

Higino Acevedo, 55, of Methuen. Charge of unlicensed operation of a motor vehicle in Whately by state police, to be dismissed on payment of $50 court costs, to be paid today.

Chen A. Cordero, 36, of Agawam. Pleaded innocent to identity fraud in Greenfield, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, (we/they) spoke with the victim, and she has since suffered a traumatic brain injury, preventing her from remembering anything from that time; furthermore Comcast has wiped the balance on the account. Must pay legal counsel fee of $150.
