Justin Shaida, 28, of Aster Court, Greenfield. Pleaded innocent to assault and battery on family/household member, released on personal recognizance, must have no alcohol and subject to screens and testing with Scram device and report to probation daily until the Scram device is available. A C276, section 56A form, was filed by the Commonwealth, an allegation of abuse under 276, section 56A, was found, continued to 6/6/17 for pretrial conference. Must pay legal counsel fee of $150.

Amy Wheeler, 29, of Aster Court, Greenfield. Found responsible for disorderly conduct, fined $100, and decriminalized, to wit, converted to a civil offense. Charge of resisting arrest dismissed on request of the Commonwealth.

Logan F. LaBonte, 18, of North Adams. Pleaded innocent to assault and battery in Charlemont by state police, must have no alcohol and subject to screens and testing. Continued to 6/1/17 for pretrial conference.

Joseph A. Fleming, 39, Parmenter Road, Bernardston. Charge of unlicensed operation of a motor vehicle in Bernardston by state police, to be dismissed on payment of $200 court costs. Charge of failure to stop for police, fined $100. Charge of operating under the influence of liquor or 0.08 percent was not prosecuted. According to a statement made by a counsel from the district attorney’s office, the Commonwealth can’t proceed with the evidence available to it.

John V. Richardson, 31, of Gage Road, Athol. Pleaded innocent to possessing a Class A drug, to wit, heroin, subsequent offense, possessing a Class B drug, to wit, crack cocaine, operating a motor vehicle with suspended license for operating under the influence of liquor, and no inspection sticker in Orange, bail set at $1,000 cash, of $10,000 surety, advised of right to drug examination. Continued to 5/23/17 for pretrial conference. Must pay legal counsel fee of $150.

According to a statement made by a counsel from the district attorney’s office, new evidence provided to the Commonwealth makes clear that the defendant should not be prosecuted for these charges. Todd M. Fredette, 50, of Pleasant Street, Athol. Pleaded innocent to breaking and entering a building in the nighttime with intent to commit a felony, vandalizing property and assault and battery, were not prosecuted. According to a statement made by a counsel from the district attorney’s office, the alleged victim didn’t appear for trial and the Commonwealth can’t proceed without him. The victim had previously showed up for trial on a different day. However, the victim has since moved out of state and has become wholly unresponsive to the Commonwealth, despite numerous attempts to communicate. Must pay legal counsel fee of $150.

Arthur T. Savoy, 59, of Drury Avenue, Athol. Admitted to sufficient facts for assault and battery, sentenced to 30 days in the house of correction, suspended. Placed on probation until 7/25/17, with victim-witness assessment of $50 and must continue with mental health treatment and have the SCRAM system applied. Must pay counsel fee of $150 or perform 16 hours of community service.

Bail set at $200 cash, must have the Scram equipment applied, must have no alcohol and subject to screens and testing daily until the Scram equipment can be established and must report to probation weekly, but daily until the Scram equipment is established. Andrea Schempp, 37, of Pine Street Extension, Shelburne Falls. Charge of assault and battery on family/household member was not prosecuted. According to a statement made by a counsel from the district attorney’s office, after meeting with the named victim in this matter, the Commonwealth has decided not to prosecute this matter further at this time.

Kelsey M. Hurlburt, 19, of South Main Street, Orange. Charges of possessing a Class A drug, to wit, heroin, and possessing a Class E drug, to wit, suboxone, were not prosecuted. According to a statement made by a counsel from the district attorney’s office, the defendant’s mother, who found the illegal substances in the defendant’s purse, has stated that she can no longer be sure that it was the defendant’s purse. There is no other evidence to prove that the purse was in the possession of the defendant. Must pay counsel fee of $150 or perform 16 hours of community service.

Found innocent of operating under the influence of liquor or 0.08 percent and operating under the influence of drugs, following a jury trial, with both found thus when a motion for required finding of not guilty at the close of the Commonwealth’s case was approved by the court judge. Charge of negligent operation of a motor vehicle was not prosecuted. According to a statement made by a counsel from the district attorney’s office, (it is) in the interest of justice. Admitted to sufficient facts for being a person under 21 in possession of liquor, but continued without a finding until 5/26/17 with victim-witness assessment of $50.
