Greenfield, Nov. 13, Judge William Mazanec III

Evan W. Roberts, 23, of Bernardston Road, Greenfield. Admitted to sufficient facts for negligent operation of a motor vehicle. Sufficient facts found, but continued without a finding until 11/12/18, with head-injury assessment of $250, and victim-witness assessment of $50, must attend and complete the eight-hour Safe driving Course, and it must be completed by 5/11/18. Found not responsible for unsafe operation of a motor vehicle, and marked lanes violation. Charge of leaving the scene of property damage dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay $50 per month probation supervision fee.

Orange, Nov. 13, Judge David S. Ross

Erika Mallet, 23, of Jasmine Road, Orange. Pleaded innocent to assault and battery on family/household member, intimidating a witness, juror, police, or court official, and assault with a dangerous weapon, to wit, a knife. Inquiry made by the court under 276, Section 56A. A C276, section 56A form was filed by the Commonwealth. Allegation of abuse under Chapter 276, Section 56A was found. Continued to 1/12/18 for pretrial conference.

Dwayne D. Boudreau, 56, of Gardner. Pleaded innocent to operating a motor vehicle with license suspended, and uninsured motor vehicle in Orange. Released on personal recognizance. Continued to 12/18/17 for pretrial conference.

Brandon J. Barilone, 19, of Chase Road, Athol. Pleaded innocent to assault and battery on family/household member, disorderly conduct, disturbing the peace, threatening to commit a crime, to wit, assault and battery, and resisting arrest. Bail set at $150 cash, $1,500 surety. Must stay away from and have no contact with a named person, and stay away from the alleged victim’s school and home. A C276, Section 56A form was filed by the Commonwealth. Allegation of abuse under Chapter 276, Section 56A was found. Continued to 12/12/17 for pretrial conference. Must pay counsel fee of $150, or perform 12 hours of community service, in lieu of regular 16 hours.

Stanley E. Hatstat, 62, of Drury Avenue, Athol. Admitted to sufficient facts for negligent operation of a motor vehicle, with head-injury assessment of $250, and victim-witness assessment of $50, and must take the eight-hour safe driver course. Charge of operating under the influence of liquor or .0.08 percent was not prosecuted, as it is in the interest of justice. Found not responsible for motor vehicle lights violation, and marked lanes violation.

Greenfield, Nov. 14, Judge Paul Smyth

John A. Riendeau, 53, of Warwick Road, Northfield. Pleaded guilty to four charges of violation of an abuse prevention order, sentenced to two years in the house of correction, and all four charge are concurrent. Placed on probation until 11/12/21 for intimidating a witness, juror, police, or court official. Must stay away from and have no contact with a named person. Must take and complete a substance abuse evaluation, and must have mental health evaluation, and must take any after-care recommended on either or both evaluations, with victim-witness assessment of $90. Must have no alcohol and subject to screens. Must conform to Scram unit program, and must have GPS service applied. Placed on probation until 11/12/21 for second charge of intimidating a witness, juror, police, or court official, and one charge of criminal harassment, with same conditions as in the first charge of intimidating a witness, juror, police, or court official. Must pay probation supervision fee of $65 per month.

Orange, Nov. 14,Judge David S. Ross

Gina M. Nolette, 25, of Winchendon. Pleaded innocent to larceny over $250, in Orange, released on personal recognizance. Continued to 12/29/17 for pretrial conference.

Gina M. Nolette, 25, of Winchendon. Pleaded innocent to breaking and entering a building in the nighttime with intent to commit a felony, and larceny over $250 in Orange, different date from previous case. Released on personal recognizance, must stay away from a Fairman Road location in Orange. Continued to 12/29/17 for pretrial conference. Must pay counsel fee of $150, or perform 16 hours of community service.

Jacob K. Surmner, 26, of Burrington Road, Charlemont. Admitted to sufficient facts for operating under the influence of liquor or .0.08 percent, in Deerfield. Sufficient facts found, but continued without a finding until 11/14/18, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $726.80. Found not responsible for marked lanes violation. Charge of possessing an open container of alcohol in a motor vehicle dismissed on request of the Commonwealth. Must pay legal counsel fee of $150, and $100 counsel contribution. Must pay probation supervision fee of $65 per month.

Sarah C. Mackenzie, 34, of Williamstown, Vt. Admitted to sufficient facts for possessing a Class B drug, to wit, cocaine, with intent to distribute in Deerfield by state police, amended down from, trafficking in 18 grams, or more, or less, than 36 grams of cocaine. Must have no drugs, and subject to screens, with victim-witness assessment of $90. Charge of unlicensed operation of a motor vehicle. Sufficient facts found. Fined $400, and $100 surfine. Found not responsible for a violation of state highway traffic regulations. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month.

Arlo H. Rhein, 20, of Elm Street, Franklin County House of Correction, Greenfield. Charge of being a fugitive from justice on a court warrant from Vermont. Bail set at $5,000 cash or $50,000 surety. Continued to 12/8/17 for pretrial conference.

Steven R. Williams, 51, of Hope Street, Greenfield. Charge of assault and battery on family/household member, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, after speaking with the named victim in preparation for trial, and reviewing all other evidence in this case, this is in the best interest of justice.

Nicholas J. Scribner, 30, of Pleasant Street, Orange. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent, in Northfield. Sufficient facts found, but continued without a finding until 11/14/18, with 45-day mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $726.80. Must have no alcohol and subject to screens and testing, and must have a Scram unit applied. Admitted to sufficient facts for assault and battery on a police officer. Sufficient facts found, but continued without a finding until 11/14/18, with same conditions as in the previous count, and must write a letter of apology to the police officer involved. Charge of negligent operation of a motor vehicle dismissed on request of the Commonwealth. Found not responsible for charges of marked lanes violation, and speeding. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month, but it may be waived while paying in another court in Orange.

Jeffrey R. Nail, 48, listed to a post office box in Orange. Admitted to sufficient facts for threatening to commit a crime, to wit, murder. Sufficient facts found, but continued without a finding until 11/14/18, with victim-witness assessment of $50, and must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Must stay away from and have no contact with a named person and must have the Scram unit applied. Charges of assault, and disorderly conduct were dismissed on request of the Commonwealth. Must pay probation supervision fee of $65 per month.

Kevin Hale, 33, of Riddell Street, Greenfield. Charge of assault and battery, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the Commonwealth is unable to meet it’s burden of proof beyond a reasonable doubt.

Jamie S. Matosky, 23, of Upper Farms Road, Northfield. Pleaded innocent to violation of an abuse prevention order, in Montague. Released on personal recognizance. Continued to 12/7/17 for pretrial conference. Must pay legal counsel fee of $150

Tina M. Deforge, 51, of Prospect Street, Orange. Pleaded innocent to violation of harassment prevention order in Greenfield. Released on personal recognizance, must abide by any 209A restraining order in existence. Continued to 1/4/18 for pretrial conference. Must pay counsel fee of $150, or perform 16 hours of community service.

Eric Bell, 28, of Fourth Street, Turners Falls. Placed on pretrial probation until 5/16/18 for assault with a dangerous weapon, to wit, a knife/cutting instrument in Greenfield. Must comply with current Department of Mental Health treatment. Must pay counsel fee of $150, or perform 16 hours of community service.

Greenfield, Nov. 16, Judge Patrick Sabbs

Lemuel V. Gonzalez, 34, of Wells Street, Greenfield. Pleaded innocent to violation of an abuse prevention order. Bail set at $100 cash or $1,000 surety and must abide by any 209A restraining order in existence. Continued to 12/7/17 for pretrial conference.
