Orange, Aug. 11, Judge William Mazanec III

Christopher D. Johnson, 46, of Gardner. Pleaded innocent to operating a motor vehicle with suspended license for operating under the influence of liquor, and failure to notify the Registry of Motor Vehicles of a name or address change in Erving. Released on personal recognizance. Continued to 10/2/17 for pretrial conference. Must pay legal counsel fee of $150 and $50 counsel contribution.

Greenfield, Aug. 14, Judge William Mazanec III

Daniel J. Obuchowski, 54, of Deerfield Street, Greenfield. Charge of miscellaneous municipal motor vehicle ordinance or bylaw, to wit, having, or drinking from, an open container of alcohol in public dismissed on request of the Commonwealth.

Kashaun K. Lowe, 23, of Chicopee. Charge of uninsured motor vehicle. To be dismissed on payment of $50 court costs, to be paid by 9/1/17. Found not responsible for unregistered motor vehicle.

Arrie Daniels, 24, of Springfield. Pleaded innocent to violation of an abuse prevention order in Greenfield. Released on personal recognizance, must have a GPS device applied, but the GPS fee was waived, and must stay away from and have no contact with a named person, and must stay away from her apartment in Athol. Continued to 10/5/17 for pretrial conference. Must pay legal counsel fee of $150.

Ronell Sumlin, 30, of Fourth Street, Turners Falls. Pleaded innocent to unlicensed operation of a motor vehicle in Greenfield. Released on personal recognizance. Continued to 10/20/17 for pretrial conference.

Dane P. Amstein, 22, of Elm Street, Shelburne Falls. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent, in Buckland, but continued without a finding until 8/13/18, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $726.80. Charge of leaving the scene of property damage dismissed on request of the Commonwealth. Must pay probation supervision fee of $65 per month.

Jack E. O’Connor, 22, of Westfield. Pleaded innocent to operating under the influence of liquor or 0.08 percent, and failure to stop/yield in Greenfield. Released on personal recognizance. Continued to 10/5/17 for pretrial conference. Must pay legal counsel fee of $150 and $50 counsel contribution.

Rene H. Leblanc, 27, of Fitchburg. Pleaded innocent to failing to provide a DNA Database sample in Greenfield by state police. Released on personal recognizance. Continued to 10/20/17 for pre-trial conference.

Orange, Aug. 14, Judge Laurie MacLeod

Frank J. Christiana, 20, of Indian Orchard. Pleaded innocent to assault and battery in Wendell by state police. Released on personal recognizance. Continued to 10/2/17 for pretrial conference.

Robyn L. Wallace, 37, of Stone Valley Road, Orange. Pleaded innocent to shoplifting at Ocean State Job Lot in Athol. Released on personal recognizance. Continued to 10/3/17 for pretrial conference.

Robyn L. Wallace, 37, of Stone Valley Road, Orange. Charge of conspiracy, different date and town from previous case, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, (this is) in the interest of justice. A charge of shoplifting at Wal-Mart in Orange has yet to be processed.

Kelsey M. Hurlburt, 20, of Walnut Street, Athol. Admitted to sufficient facts for possessing a Class A drug, to wit, heroin with intent to distribute, but continued without a finding until 8/14/18, with victim-witness assessment of $50. Must have no drugs or alcohol, and subject to screens/tests, must take and complete a substance abuse evaluation, and take any follow up care treatment recommended, including residential treatment, and must forfeit $599. Charges of conspiracy to violate drug laws, and being present where heroin is kept, were both dismissed on request of the Commonwealth. Must pay legal counsel fee of $150. Must pay counsel fee of $150, or perform 16 hours of community service.

Raymond J. Bessette, 53, of Holyoke. Charge of operating a motor vehicle with license suspended in Erving. To be dismissed on payment of $100 court costs with payment by 9/8/17. Found not responsible for speeding in violation of special regulation.

Patrick Marz, 37, of East Prospect Street, Erving. Placed on pretrial probation until 2/13/18 for larceny over $250, and must make $300 restitution to the victim. Placed on pretrial probation until 2/13/18 for charges of vandalizing property, and larceny under $250. Must pay counsel fee of $150, or perform 16 hours of community service.

Sylvester Barjolo, 32, of Worcester. Pleaded innocent to operating under the influence of liquor or 0.08 percent, second offense, operating a motor vehicle with license suspended, subsequent offense, intimidating a witness, juror, police, or court official, being a vehicle operator refusing to identify him or herself, marked lanes violation, no license in possession, and no registration in possession in Erving. Released on personal recognizance. Continued to 10/6/17 for pretrial conference. Must pay legal counsel fee of $150.

Larry E. Smith, 54, of Gardner. Pleaded innocent to two charges of possessing a Class B drug, to wit, oxycodone, one charge of possessing a Class B drug, to wit, cocaine, one charge of possessing a Class B drug, to wit, percocet, one of conspiracy to violate drug laws, and one of failure to wear a seat belt in Erving. Bail set at $7,500 cash, by agreement. Continued to 10/6/17 for pretrial conference. Must pay legal counsel fee of $150.
