Judge keeps $50K bail for Holyoke man facing gun, drug charges

GREENFIELD — A Franklin County Superior Court judge on Thursday declined to adjust the bail of one of the Holyoke men facing drug and gun charges after allegedly leading police on a vehicle chase and foot pursuit in January 2022.

Judge David Hodge decided to keep Luis Colon, 37, held on $50,000 bail, on the same bail that was transferred from Greenfield District Court when Colon pleaded not guilty in Superior Court.

Colon was arrested, along with passenger Edgar Hernandez, after Colon allegedly committed a marked lanes violation and refused to stop for Greenfield Police Officer Patrick Merrigan at around 9 p.m. on Jan. 14, 2022. The two men allegedly pulled into a resident’s driveway on Highland Avenue and fled on foot into the woods.

Hernandez also reportedly threw a package out the window. Police later found the package, which contained a loaded pistol with the serial numbers removed.

According to Deputy Police Chief William Gordon, K-9 Niko tackled Hernandez, allowing Merrigan, Niko’s handler, to apprehend him. State Police troopers apprehended Colon as he exited the woods a few blocks away.

Colon is represented by defense attorney Kedar K. Ismail, who attended Thursday’s hearing remotely. The case is being prosecuted by Assistant District Attorney Matthew Thomas.

In December 2022, Hernandez, 39, pleaded guilty to a firearms violation with one prior violent or drug crime. He was sentenced to three to five years in state prison.
