Orange, Sept. 18 Judge David S. Ross

Miranda L. Brooks, 22, of School Street, Athol. Pleaded innocent to assault and battery with a dangerous weapon, to wit, an ashtray. Released on personal recognizance. Continued to 10/27/17 for pretrial conference. Must pay counsel fee of $150, or perform 12 hours of community service.

Greenfield, Sept. 19, Judge William Mazanec III

Chance P. Powell, 26, listed as homeless, of Shelburne Falls. Pleaded innocent to causing injury under $500 to a church/synagogue, and violation of fire prevention regulations in Shelburne. Released on personal recognizance. Continued to 10/30/17 for pretrial conference.

John L. Harmel, 28, of Holyoke. Admitted to sufficient facts for operating under the influence of liquor or 0.08 percent. Sufficient facts found, but continued without a finding until 9/18/18, with 45 days mandatory loss of license, plus OUI fee of $250, OUI victims assessment of $50, head-injury assessment of $250, and victim-witness assessment of $50. Must take and complete the driver alcohol education program, and pay the fee of $726.80. Must take and complete a substance abuse evaluation, and take any after-care treatment recommended. Must have no alcohol and subject to screens and testing, and must write a letter of apology to a state trooper. Charges of vandalizing property and negligent operation of a motor vehicle both dismissed on request of the Commonwealth. Found not responsible for possessing an open container of alcohol in a motor vehicle, and of having an open container of marijuana in a vehicle. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month.

Harold T. Hayward, 65, of Potters Road, Charlemont. Pleaded innocent to negligent operation of a motor vehicle, leaving the scene of property damage, unsafe operation of a motor vehicle, and marked lanes violation, in Greenfield. Released on personal recognizance. Continued to 11/1/17 for pretrial conference. Must pay legal counsel fee of $150 and $50 counsel contribution.

Greenfield, Sept, 20, Judge William Mazanec III

Larissa Howard, 32, of Oak Courts, Greenfield. Pleaded guilty to assault and battery. Fined $75, plus $25 surfine. Charges of armed and assault for burglary, vandalizing property, assault and battery with a dangerous weapon, to wit, a shod foot, intimidating a witness, juror, police, or court official, and of threatening to commit a crime, to wit, murder, all dismissed on request of the Commonwealth. Must pay legal counsel fee of $150.

Larissa Howard, 32, of Oak Courts, Greenfield. Found responsible for operating a motor vehicle with license suspended, different date from previous case. Fined $50.

Dana L. Rice, 53, of Main Street, Charlemont. Charge of being a sex offender failing to register, Level 2 or 3, in Charlemont by state police. Bail set at $2,000 cash, or $20,000 surety. Must register as a sex offender appropriately. Must pay legal counsel fee of $150.

Greenfield, Sept. 21, Judge William Mazanec III

Joshua Eastman, 33, of Maple Street, Greenfield. Charges of operating a motor vehicle with license suspended, and number plate violation to conceal identification in Colrain. Released on personal recognizance. Continued to 10/26/17 for pretrial conference.

Ryan P. Waldron, 41, of Bridge Street, Buckland. Pleaded innocent to operating a motor vehicle with license suspended, and uninsured motor vehicle. Released on personal recognizance. Continued to 10/30/17 for pretrial conference.

Eric Bell, 28, of Fourth Street, Turners Falls. Pleaded innocent to assault with a dangerous weapon, to wit, a knife/cutting instrument in Greenfield. Released on personal recognizance. Continued to 11/7/17 for pretrial conference. Must perform 16 hours community service in lieu of legal counsel fee.

Paul W. Penerian, 32, of North Main Street, Orange. Pleaded innocent to assault and battery on family/household member, and intimidating a witness, juror, police, or court official in Montague. Released on personal recognizance. Must stay 50 yards away from and have no contact with the alleged victim, and stay the same away from a specified address in Turners Falls. Must have no abuse or harassment of the alleged victim. Must have police escort to pick up property, and child visitation to be done through a third party. A C276, section 56A form was filed by the Commonwealth, and an allegation of abuse under 276, section 56A, was found. Continued to 11/7/17 for pretrial conference. Must pay legal counsel fee of $150.

Greenfield, Sept. 22, Judge Laurie MacLeod

Dana K. Larsen, 48, of O Street, Turners Falls. Pleaded guilty to negligent operation of a motor vehicle. Placed on probation until 3/21/19 with victim-witness assessment of $50, and must comply with all terms at the Veteran’s Court, and must have no alcohol, and subject to screens and testing. Found not responsible for marked lanes violation. Charge of operating under the influence of liquor or 0.08 percent, fourth, or greater offense, was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the defendant is entering the Veteran’s Court on the charge of negligent operation of a motor vehicle. Must pay legal counsel fee of $150. Must pay probation supervision fee of $65 per month.

Rene K. Franzen, 56, of Deerfield Street, Greenfield. Charge of vandalizing property, to be dismissed on payment of $100 court costs.

Lemuel V. Gonzalez, 33, of Princeton Terrace, Greenfield. Pleaded guilty to assault and battery on family/household member, sentenced to 90 days in the house of correction, and given credit for time served. Charge of strangulation or suffocation were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the victim asserted her Fifth Amendment right not to testify. Without her testimony, the Commonwealth cannot prosecute this charge. Must pay legal counsel fee of $150.

Orange, Sept. 22, Judge Laurie MacLeod

Alyssa R. Forgette, 22, of Cooleyville Road, New Salem. Placed on pretrial probation until 3/20/18, for larceny over $250, and must pay $2,670 restitution to the victim with probation setting a plan of $450 a month until paid.

Miranda L. Brooks, 22, of School Street, Athol. Pleaded innocent to assault and battery. Released on personal recognizance. Must stay away from the alleged victim, and from a specified address in Athol. Inquiry made by the court under 276, section 56A. A C276, section 56A form was filed by the Commonwealth. An allegation of abuse under 276, section 56A, was found. Continued to 10/27/17 for pretrial conference.

Shane Fugere, 26, of Tully Road, Orange. Pleaded innocent to possessing a Class B drug, to wit, heroin, in Athol and must take the Northwestern District Attorney’s Drug Diversion and Treatment Program. Continued to 10/27/17 for report of defendant’s program.

Intha Lepkham Jr., 35, of Holyoke. Pleaded innocent to possessing a Class D drug, to wit, marijuana, possessing a Class B drug, to wit, ecstasy, and second charge of possessing a Class B drug, to wit, cocaine, plus assault and battery on a police officer, disorderly conduct, and unlicensed operation of a motor vehicle, in Leverett. Bail set at $100 cash, or $1,000 surety. Continued to 10/16/17 for pretrial conference. Must pay counsel fee of $150, or perform 16 hours of community service.

Christy M. Thibeault, 57, of Silver Lake Street, Athol. Placed on pretrial probation until 12/22/17 for assault, and must have no abuse of the alleged victim. Must pay counsel fee of $150, or perform 16 hours of community service.

Kevin H. Neville, 42, of Old State Road, Erving. Pleaded innocent to disturbing the peace. Released on personal recognizance. Continued to 11/16/17 for pretrial conference.

Larry Whaley, 47, of Starrett Avenue, Athol. Pleaded innocent to operating a motor vehicle with license suspended, amended to subsequent offense, and speeding in violation of special regulation in Warwick. Released on personal recognizance. Continued to 10/27/17 for pretrial conference.

Holly A. Boisvert, 46, of Davis Street, Greenfield. Pleaded innocent to operating a motor vehicle with license suspended, and miscellaneous motor vehicle equipment violation in Orange by state police. Released on personal recognizance. Continued to 10/27/17 for pretrial conference.
