Javier Rivera, 42, of Bouker Street, Greenfield. Charges of assault and battery with a dangerous weapon, to wit, a knife/cutting instrument, possessing a Class B drug, to wit, cocaine, assault and battery on family/household member, and malicious damage to a motor vehicle were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, defendant has been indicted and arraigned in Franklin Superior Court.

Mollie L. Peters, 37, of Chapman Street, Greenfield. Pleaded guilty to violation of an abuse prevention order. Placed on probation until 2/27/19, with victim-witness assessment of $50, and must abide by any 209A restraining order in existence, plus a written finding that the certified batterer’s program is waived. Pleaded guilty to second charge of violation of an abuse prevention order. Placed on probation until 2/27/19, with same conditions as in count one. Must pay $50 per month probation supervision fee, or perform four hours per month community service.

Christopher Russo, 38, of Aster Court, Greenfield. Pleaded innocent to two charges of aggravated rape of a child, with five-year age difference, two charges of indecent assault and battery on a child under 14, one charge of unnatural act with a child, and attempt to commit a crime were not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, the defendant has been indicted and arraigned in Franklin Superior Court, and the case will be prosecuted in that venue going forward. Bail was set at $20,000 cash or $200,000 surety.

Jovan Van Guilder, 34, of Brattleboro, Vt. Admitted to sufficient facts for assault, amended down from assault and battery on a person 60 or over, or disabled, with injury. Sufficient facts found, but continued without a finding until 4/29/19, with same conditions as listed in the following case. Charge of disorderly conduct dismissed on request of the commonwealth. Must have mental health evaluation and take any after-care recommended and must sign releases so that the probation office can monitor attendance at programs ordered by the judge. Admitted to sufficient facts for assault and battery on a police officer. Sufficient facts found, but continued without a finding until 4/24/19 with same conditions as in first count. Charges of disorderly conduct, negligent operation of a motor vehicle, leaving the scene of property damage and resisting arrest all dismissed on request of the commonwealth. Must pay probation supervision fee of $65 per month.

Fined $200, plus head-injury assessment of $250, with 60-day loss of license. Pleaded guilty to resisting arrest. Fined $100. Found not responsible for marked lanes violation. Charge of trespassing dismissed on request of the commonwealth. Charge of operating under the influence of drugs was not prosecuted, as, according to a statement made by a counsel from the district attorney’s office, as the defendant is pleading to negligent operation of a motor vehicle. Given the fact of this case, that is an appropriate resolution on this matter, and as a result this is in the best interests of justice. Must pay legal counsel fee of $150 and $50 counsel contribution.

Kevin M. Gryckiewicz, 29, of Springfield, Vt. Pleaded guilty to operating under the influence of drugs in Bernardston by state police.
